ok so here is the situation

i'm 24 i came up from Israel i'm already 6 years in the us with H4 expired visa and i do have the i-94 paper.

my girl friend has green card for like 2 years now she suppose to go for the citizenship exam

my question is if its possible to get married to her and start the naturalization process or should i wait until she gets her citizenship?

i heard i dont know how true it is but that helps a lot if I'm getting married to her before she gets that citizen status?

now while she didn't get it should i start applying right after the marriage the i-130 forms and just go thru it like as if she was citizen?

thanks for the help.

If your Girlfriend has only had her Greencard for 2 years, she can not apply for citizenship until she has held her greencard for 5 years, unless her greencard was based on marriage to a USC and she is still married to the USC then she could apply after 3 years as a greencard holder for Citizenship. So I am very confused as to how she can be about to file for Citizenship. Please give more detailed information as to her status.

You have an expired H4....so if you leave the country you'll probably have to stay home for a long time since you are now illegaly. Your gf can't naturalize in the short time she has. If you too got married you would have to leave the US and when a visa number is available you can come: this takes up to 7 years. Please give more details.

Don't let the choices chose you, chose the choices that you want.

ok so she got her green card thru her mother so she need to apply for citizenship this October, but once she gets thru the exam and she has a positive answer and she goes to court and they all happly go thru the legion, then she can apply the i130?

question: does she have to wait for her passport to come?

or right off the bat, when she passed the exam i can start the process?

or should i get married before and file the papers after she gets the citizenship. it makes sense to do it this way so it will look more legit. right?

how long does it take from the moment she files for citizenship to the moment of getting the date of the exam?

if she were to do it in California san francisco ?

Still don't see how she qualifies for citizenship after only two years even if it came via her mother. Unless of course she has not yet reached the age of majority and she will get her citizenship from her mother as well.

Even though we don't think she's eligible for naturalization for a few years, I'll still answer your question. Right now, the San Fran office is working on applications from last November. So the answer is 10-11 months, at least a year total waiting time.
