HELLO EVERYBODY, I'M NEW HERE, I HOPE YOU CAN HELP ME WITH MY CASE A LITTLE BIT. I GOT MY INTERVIEW ON FEB-20-08, THE OFFICER TOLD US THAT WE WILL BE RECEIVING A RESPOND WITHIN OF THE NEXT 2 OR 3 WEEKS. AFTER 3 MONTHS OF WAITING, WE CALLED TO THE CUSTOMER SERVICE TO KNOW ABOUT IT, SO ON MAY-27 THEY SENT US A LETTER TELLING US WE HAVE TO WAIT ABOUT 6 MONTHS MORE BECAUSE THEY STILL WORKING ON IT.

I DON'T KNOW IF WE HAVE TO MAKE AN APPOITMENT WITH INFOPASS TO KNOW ABOUT MY CASE, OR JUST WAIT THE TIME THEY TOLD US.

THE DELAY COULD BE BECAUSE THEY ARE WAITING FOR MY NAME CHECK WITH THE FBI??

I DON'T UNDERSTAND WHY IT IS TAKING SO LONG... I WILL APPRECIATE ANY ADVICE. THANKS A LOT.

If the delay is the FBI name check, you should have been told this at the interview. Also, what does the letter say?

My husband's application was significantly delayed (nearly 2 years) because of the FBI check. We did check in w/ USCIS every six months and typically received the same letter in response, every time. The letter did specifically state that our application was delayed because of the FBI background check. We were also told at the interview that our application couldn't be approved until that information was obtained.

If you're not certain that this is the hold-up, I'd make an INFOPASS appointment and at least find out what is delaying the application. If it is indeed the FBI check, there's not much you can do but wait. Fortunately, applications aren't languishing in name check for years like they used to, following a rule change. If it's something else, find out what it is. You also may consider contacting the office of your senator or representative to help you get more information about what's delaying the application.

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

my husband waited 3 years in name check and finally got the green card after they made some agrement to clear out the back log. we still dont know if he was officially cleared or just a part of the agreement.

I am waiting since june 2005. They call me in 2005 for the interview and then they cancell it without any reason. Send me the same ####### to wait for 6 months and now 6 months is converted into over 3 and a half years and still application is in pending.

I THINK WE ARE GONNA WAIT UNTIL NOVEMBER, IF THEY DON'T GIVE US AN ANSWER BY THEN, THEN WE WILL MAKE AN INFOPASS APPOINTMENT.

AS MY AOS STILL PENDING... ON AUGUST WE SENT THE I-765 FORM BECAUSE I WOULD LIKE TO WORK (WE DID NOT APPLY FOR IT WHEN WE DID IT WITH MY AOS) SO ON AUGUST 29-2008 THEY RECEIVED IT. LATER, THEY SENT US A NOA FOR THE BIOMETRICS APPOITMENT, SCHEDULED ON SEPTEMBER 20. THEY SAID ME THAT WILL TAKE ABOUT 90 DAYS TO RECEIVE MY EAD CARD, BUT COULD BE LESS THAN THAT. ANYBODY KNOWS ABOUT IT??? THANKS SO MUCH...

60 -90 days is typical (exceptions do apply)

My EAD took exactly 59 days to be approved even though I did a walk-in biometrics. But I've seen people that have waited for 5 months. If your name check is delayed your Adjustment of Status it could delay your EAD. Just a thought..

that's a good question, is the EAD application affected by the FBI name check? If it takes more than one year, can you renew your EAD based on the fact that AOS is still pending?

EAD's are affected by RFE's for the I-485... If the I-485 is still in normal process mode (which the name check is), I would expect no effect on the EAD for this reason.

WELL, IT'S ABOUT A MONTH AND 5 DAYS WAITING FOR MY EAD SINCE I GOT MY BIOMETRICS AND THE WOMAN WHO TOOK MY BIOMETRICS TOLD ME, IT TAKES 90 DAYS. THERE IS NOTHING TO DO JUST WAIT. ALSO I DON'T HAVE NEWS ABOUT MY AOS, STILL PENDING... THIS IS REALLY FRUSTAITING, BUT NOTHING I CAN DO....
