My fiancee visa was denied and I called both of my senators to help. Neither got anywhere, just a form letter from the consulate. What senators have helped you? I want to call mine back and tell them it is possible to help me if they try hard enough, but I would like names of those who have actually succeded in helping someone with a denial so that I could be more specific in convincing them to try again.

Most Senators have someone in their staff that directly works on these types of inquiries/cases and typically they don't just send out form-letters.

Did you receive and fax-back a release of information form? (They can't do anything without this.) :thumbs:

Did you receive and fax-back a release of information form? (They can't do anything without this.) :thumbs:

The form letter was from the consulate. Yes, I sent releases to all of the, 2 senators and one representative. I did speak to the persons that handle these types of inquiries.

No senator can help get an unapprovable visa application approved....

The form letter from the consulate simple said "untruthful" but in the interview, the interviewer seemed to have a problem with our meeting online six weeks prior to my final divorce decree and the fact that is was only 3 months between the time we met online and the time we met face to face. Both of those seem ridiculous reasons. Her English is not good either, but we had 400 pages of chat messages.

Is your petition still there? You're going to want to try to keep it there if you can and will most likely need to hire an attorney there to do so. I'm sure pushbrk will have some advice for you when he chimes in.

I have tried to register there, but am having a ###### of a time getting access. They say to contact an adminstrator, but the link to do that does not work.

Sorry, it does not say untruthful. I don't know where I got that. It says that we do not have a bona fide relationship. It is just a form letter and does not address the specific reason for denial.

To help you, we really need to know exactly what the notice says, not just your interpretation of it. Either way though if the denial is for lack of a bona fide relationship and doesn't offer you the opportunity to submit overcome evidence, you need an attorney in Guangzhou to help you. If the reasoning is nothing more concrete than the timing of your meeting, the attorney is likely to be successful but it will be expensive and you need to act as quickly as possible. I mean like last week. Otherwise you are looking at several months to resolve the issue and the resolution is unlikely to be favorable. K1 cases that make their way back to the USCIS, are generally not considered further. They just treat the petition approval as expired and let you start over again with the same issues hanging. Best to address it now.

I have it in front of me. This is the letter my fiancee was given at the consulate.:

Dear K visa applicant:

The consulate is unable to issue a K visa because according the to the section of the Immigration and Nationality Act, section 221(g) you do not fulfill the eligibilty requirements for the petitioned visa. The consulate has determined, based on your testimony, documents and any other evidence, that you do not have a bona fide relationship with the petitioner. The Consulate will now return your case.....

No direct explanation. We had documentation of more than a year's correspondence, many photos of the two of us of two trips to China for a total of five weeks, airline tickets, etc.

Pushbrk is right... get a good immigration attorney (and I am usually the last person who would recommend an attorney). The burden of proof is on you to overcome the reasons for the denial, so you will need a good attorney to examine the case & advise you on what to do. Based on what you've said I can't say if you have a fighting chance or not to get the denial overturned. Good luck!

OMG! My fiancee and I have a similar situation... we met online three months prior to my final decree. (My ex knew, we are still friends and I told her to go ahead and date as well; we were on no hurry to finish the paperwork.) But we met in person 8 months later and I spent the entire summer with her in BKK (yes I have a great job, lol). We also traveled around Asia together and have literally 1000s of photos. I'll make sure she takes at least 100 pix and maybe the DVD of our Thai engagement ceremony along with two other DVDs of photographs to the interview. Hopefully this will mitigate any issues....

Maybe you could marry her in China and apply for a K3... I've heard that's easier.

(My ex knew, we are still friends and I told her to go ahead and date as well; we were on no hurry to finish the paperwork.) But we met 8 months later and I spent the entire summer with her in BKK (yes I have a great job, lol). We also traveled around Asia together and have literally 1000s of photos. DVD's are not acceptable evidence media...
