Scared about flight!!

Timeline

I have just booked a ticket to fly out to the States for 2 weeks as a supprise for my fiance's birthday.

However, we are in the process of the K1 visa.

I have never overstayed on the VWP, and it will be 11 months since my last entry when I arrive, so I am definately covered by the VWP.

Will there be a problem with me getting through checks because of my impending visa?

At the time I won't have a job, and live with my parents, so it's hard to provide proof of intent to return other than our obvious efforts to do things 'by the book' by applying for the K-1 visa.

Our visa is at a standstill at the moment while we wait on a copy of my fiance's birth certificate. There was a problem with obtaining it but we expect to have it sent off to NSC within the next 2 weeks. The flight is booked for 21st March; from Birmingham UK to Newark and then on to Oregon (though I've allowed a good 7 hours between flights in case of complications!). I do have a return ticket.

I'm just worrying now about being turned away!!!

Yyou always run the risk of being denied, that is why it is SO important to have proof that you will be returning home. If you do not have a job & live at home.............do you have any bills in your name? a car? they may give you a hard time if you don't show enough reason to return home. I am not trying to discourage you, but you will need something to show them.

Your best defense will be your plan to file for the K-1, if you are questioned, but you may not be too extensively. Just be polite and answer any questions you are asked truthfully without giving out unnecessary information.

Q: What's the purpose of your visit?

A: I'm here for a holiday (true!)

In other words, don't volunteer the fact that you're here to see your boyfriend unless you're specifically asked. If you're not a VWP abuser and it's been almost a year since you came over, you shouldn't have too much of a problem.

And, as I said, if you are questioned, you can say, truthfully, that you've come over to help to prepare paperwork for your visa and that you'll have to head back to the UK to finish the process! :thumbs:

I think you'll be fine, but you can never tell.

I was questioned at EWR and it was only when I mentioned my intentions re the K1, that the CBP were fine with me.

I agree with Pax-don't lie-but that doesn't mean you necessarily have to say you are visiting your boyfriend. Just be prepared either way. If you do have proof that you will be going home-bring it!!!!!!

Well i spent 3 montns in USA and came home to UK for 1.5 months and then i came back.... i had evidence and went through JKF. they asked one question, that was it, and i told him i was visiting my fiance... it really is luck of the draw.... good luck

Since your I-129F has already been filed, your name will already be in the system. So, when your passport gets scanned, the CBP agent will see that you are the potential recipient of a K-1.

My recommendation would be to be totally honest, from the very first words out of your mouth. I can't see any reason why you wouldn't tell him exactly what you told us in the first sentence of your original post. Also, as you said, you are following the process, so it is to your advantage not to jeopardise your application by overstaying.

Personally, I would not follow pax's advice. As I mentioned, the CBP officer already knows that you are a potential K-1 recipient, so if you say that you're over for a holiday, he'll immediately think that you're trying to hide something. Just my 2c.

My advice would to not say you are "going on a holiday" but to be honest and say you are going to visit your Fiance. I visited during our K1 process and when asked the purpose of my trip I was honest and said.. I am going to visit my fiance, we have a K1 visa pending. He asked when the wedding was to which I responded, "once the K1 has been approved". He then smiled and told me I had obviously done my homework. I think you will have more chance of being turned away if you seem to be hiding information or trying to cover something up.. they are trained to look for these things so just be pefectly honest and dont hold back on the information. If you try being vague and just saying going on a holiday and they find out you have a K1 visa in the works they may think you are trying to sneak in.. so tell them who and why

ummm well if u haven't been turned away before.....then u prob will have no problems. I've been turned away twice (and had a 12 month ban on me) so i dont think its in my best interest to go anywhere but u have a nice time :D

There's a good chance you could be turned away.But you can still try. Bring anything that shows ties to your country. Car lease, bank statments, if your going to college , bring documents proving that. Any bill in your nameDo you have a medical appt or something coming up?, if you do, bring documentation to show that. Without a letter of employment & rent reciept it might be hard.

I had ALL that stuff and was still denied.I had been going to the states quite often without ever a problem until one jerk decided to be mean. Just be honest. Tell them you are coming to suprise your fiance for his birthday.

If you are denied, don't worry. My denial had no bearing on my K-1 interview. They did mention it but said it happens all the time.
