Hi, I'm new here, and I have a very serious problem. I met a girl on the internet, fell in love with her, and visited her in the Philippines three years ago now. I've gone through a rough stretch in my life for those past three years. I've always been planning to bring her over here so we can get married, but have read that it is required that you must have visited her in the past TWO years. Things are getting edgy now, and she's said that there are people that have somehow bypassed this regulation. Is this correct? Or something that she's misunderstood? And if so, how? Any help would be very greatly appreciated. Thanks

No, your fiancee is mistaken. USCIS is very adamant about that 'having met within the last 2 years' requirement. Some people have tried for hardship waivers due to health or finances, but I don't recall of any being allowed even for serious health issues. When you submit the I-129f you need to provide evidence (passport stamps, air travel proof, etc.) that you have physically been together within the two years immediately prior to filing. You will need to find some way for the two of you to get together again before you file. If you file without meeting this condition, your application will be denied and you will have just wasted your money.

i'm not sure how anyone can bypass the requirement for a k-1 visa to have met within the past 2 years of filing the i-129f - maybe she's thinking of a different visa type, like the k-3?

my thoughts, if you are going to go the route of a k-1, go visit her again so it's not an issue.

Thank you Charles, I was hoping to visit her again next month, but she's run out of vacation time and doesn't want me spending money when she won't be able to take advantage of our time together... it's starting to be a very complicated situation here. But I'll be sure to look into that K-3 visa as a possibility!

k-3 is a visa for those already married. still works out to the same deal, you'd have to go there.

You've already waited 3 years. Just go over there are hang out on weekends and after work. There's no requirement that you have to spent every waking hour together. Have her call in sick a couple of days if possible.

If her vacation time is fairly soon just wait a little longer.

Thank you all. I just wish that the immigration laws weren't so draconian, I also hope she will wait for me, we're so close to being together!

If she won't wait at this point, IMHO you haven't lost anything!

Yeah, why had to have met in the last two years? Who cares, I can almost understand needing to meet sometime, but why the limitations? Especially if you have been in contact with each other. Oh well, most everyone here has been there, done that! Why such a hurry after three years? None of my business!

Gotta do what you gotta do.

Well, we actually met five years ago, and I went out there three years ago, so, she's waited long enough... and it's showing. I was a fool to wait so long, but my life has taken several steps backwards since we met, and I just wanted to have everything just right for her to be here and it's taken me this long to re-establish myself. I'm just hoping that she can wait just a bit longer.

I think it's a great idea to see each other again. If you haven't met in person in the last 2 years (you mentioned it was 3 years), you certainly don't want to be petitioning anyone to come here to marry. You mentioned things had changed for you in the last few years, and you had taken some steps backward. People change. It's hard enough one party changing with their partner by their side, let alone changes you BOTH might have made while you've been apart.

If she's that anxious about not waiting, or wanting to side-step the issue, you might want to spend some time on the relationship before applying for a K-1.

Best of luck!

This is one of the few situations that will with almost 100% certainty cause a petition to be denied.

YMMV

I want to thank you all for your comments and support during this. Hopefully, she will be able to wait, as I am going there in three months, she was able to take some leave to see me again and I'm so happy to get back over there one more time!
