Timeline

Hi All,

I am so upset that I can't even think straight. We filed AOS for my wife in early August and received the NOA's and the biometrics letter for an appointment September 5. While I was out of town last week on a business trip my wife who maybe drinks once every 2-3 months and has never had as much as a parking ticket was arested for DUI. She naturally is discusted with herself and very worried about being denied AOS so I would like to hear if anyone has had a similar situation in the past. Naturally we are not interested in hearing lectures about morality because we both know what she did was wrong so please just let us know if you have been in the same situation before or if you have first hand knowledge of an equal situation.

It's not a crime of moral turpitude, she'll be fine.

Unfortunately the timing is awful, had this been after the biometrics it wouldn't show up on the Fingerprint/CJIS check. They're going to ask for a certificate of disposition about the outcome of the case or what the judgment is. But it won't stop her from adjusting status.

Get court papers detailing what the outcome of it is or what she has to do. I doubt you'll be RFE'd for it but you should have it in case of an interview.

All other issues aside, until she is convicted of the DUI, she is innocent of any wrongdoing. Go ahead with the biometrics, obtain a good attorney for her court hearing on DUI, and hope for the best. Most good attorneys will, if she is found guilty, immediately appeal the verdict based on some technical matter. Of course, this is all big bucks for you. The goal will be to keep her from being convicted as a felon until after the AOS is granted. (At least in Virginia, it is a felony...not simply a misdemeanor) Prepare for your auto liability insurance premium to skyrocket or even be cancelled no matter what happens -- maybe in a month or so.

That's very good advice too. A good lawyer that knows her immigration status is an important issue will be able to perhaps even lessen the crime or find channels to get it dismissed. But it will cost a bit.

Unfortunately I don't know much about your situation. But all I have to tell you is, have faith and be positive. And as you said, it was an incident. It happens. It's not like she has a criminal background or this has happened so many times before. So try not to worry too much and let's pray that everything will work out. I am sure it will!
