I am wondering if anyone know what happens if your first k1 has gone to the abyss of AR which it may get lost in for years and you file a new one. Does the first one automatically get cancelled ? Does it still live on ? I tend to be the inpatient type and don't like the idea of just waiting for something to happen. I will be spending almost a month in the village attending the burial and assuming things are still in never never land when I get home I am wondering what would happen with a second application and it's affects on the first one. The second one would make proper to the first but does the first one die ?

First visit:2007-09-12 to 2008-09-23

I-129F Sent : 2007-11-24

I-129F NOA1 : 2007-11-30

I-129F NOA2 : 2008-03-31

NVC Received : 2008-04-21

NVC Left : 2008-04-23

Consulate Received : 2008-04-28

Packet 3 Received : 2008-05-20

Interivew date : 2008-08-07 CO asks inappropraite questions

His father died: 2008-08-18

Retain Marc Ellis 2008-09

Visited Nigeria again: 2008-11-12

petitioned returned to CSC :2008-11-27

returned to USA 2008-12-13

His father buried 2009-01-03

picks up K1 visa Nov 2009

Marriage Dec 2009

take throne as Igwe /Lolo 2010 or 2011

Unless the first one was cancelled or time ran out on it you can't just file another.

If you're talking about your own situation (interview 8/7/08) it will do you no good to send another K1. Even if you cancelled the first and started all over again you are most likely going to face the same thing that put you into AR in the first place.

kim i asked this same questions sort of cuz as u know mine is STILL in security i wanted to know if i could cancel it and refile and was told u can not do anything u have to wait until they are finished with what ever it is that they are doing to even be able to cancel it and that if u file another while waiting even if it is for same person it will be rejected and u will loss the money it cost to file it.........hope that helps some

Actually there will be a lawsuit against DHS dealing with the first one. But that is another tale.

Why dont you just marry your fiance at his/her country so then you just file a K3 instead of K1. You cant file K1 twice because all you will do is just delay your K1 visa for your fiance as it is already in AR (Administrative Review).

ouch! sorry to hear that. Perhaps marriage and a spousal visa if your circumstances are unique.

I just saw this thread, sorry it is old but I wanted to say that if the K1 is still alive then filing a K3 will cause misrepresentation.

There is a long article floating around on that somewhere here, written by a lawyer.

Also even with a K3 you will end up and get stuck at the same place.

You have to ask the embassy first if the K1 petition can be closed out at this point and then get married and do a K3.

But chances are the AR will happen again at the same place with the new petition.

If you file a K1 and then during the waiting period you get married and file Cr1/k3 how is that misrepresentation ? You have changed your maritial status and need the new filing ? Not that I have married just looking at all the angles
