Hi everyone :)

I still have a long road to run before I am at this stage but I got a question: after getting married, you have a limit as to when you have to apply for AOS ? Like.. once you are in the US you have 90 days to get married.. and after getting married you have xx days to apply for AOS :) something like that if you got me :blush:

You should, technically, try to file your AOS application prior to the expiry of your I-94. Once you file, your status changes from K-1 visa to AOS applicant and you are legally present in the US beyond the expiry date on your I-94. If your I-94 expires before you file you begin to accumulate 'out of status' days. Now, a few of those aren't a problem, but if you accumulate 6 months of out of status days and leave the US during the processing of your application, even if you have an advance parole, you run the risk of a 3 year ban and will probablyl not be allowed back in the US. As well, the process can take anywhere up to 2 years or more (although many are being processed much more quickly than that) so the sooner you get the application filed, the sooner it can be processed.

Waiting a few days until you are able to get all of your paperwork together is probably not going to be a problem, but you do want to make the application a priority.

btw - you will receive your I-94 when you activate your K-1 visa and enter the US. Immigration officials will staple it into your passport and write down a date 90 days after your arrival. That is the start of your 90 days so you will have an actual date available that will tell you when the 90 days are up. The I-94 also makes up part of your AOS application.

I would not wait. The sooner you apply for AOS, the sooner you can travel, work, get driver's license, apply for SSN, and other good stuff. You'll also get the GC sooner!

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

We waited several months before filing AOS ($400 was a little too much to spend on that at that point) and i was approved without any problems.. I (obviously) recommend doing it as soon as possible, but except for the reentry ban for too much overstay, its not a big deal if you wait a little while before filing, except that it takes that much longer before you get your green card!

You can "oficially" file 3 mos. after marriage.

I dont know why you keep posting that information.... it makes people think they have to wait 3 months from when they get married... and as we all know that is not the case.....

Thanks for the clarification Kez - that was EXACTLY what I thought when i read that 'oh I have to wait 3 months after I get married'.

So basically - I can file for AOS right away yeah? - I'll start saving now :)

Applied for K1

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

You can prepare all the forms and supporting documents before you marry, and file as soon as you get the marriage certificate.

I don't know why you keep posting that info. It makes people think they have to wait 3 months from when they marry. As we all know, that is not the case.

Thanks for the info. I then guess that my Immigration atty. was wrong when he said this and waited 3 mos. after my marriage to submit my immigrant ex-wife's AOS paperwork. Since he obviously doesn't know what he's talking about, I'll go ahead and correct him.

Your immigration attorney is wrong and is likely stalling to get more moolah out of you! You can file for AOS immediately after you get married, and that came from MY immigration attorney who happens to be in the top 10 in the United States.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

I am about to move to the US as my K-1 just got approved and would like to get everything ready for filing AOS the day after our wedding. Can anyone tell me exactly which forms are required? I'd like to start working on them right away. Thanks a lot in advance.

Congratulations on your K1 approval.... if you go to the guides at the top there is all the information about filing for AOS from K1...

You are unlikely to be able to file the day after your wedding as you will need to have a certified copy of your marriage certificate and that takes anything from 3 days to 2 weeks....
