Could somebody if the expedite request apply to both USC and LPR or just USC. I appreciate your help

expediting of the adjudication of the I-130 petition does not necessarily mean that an expedite of an available visa number will occur

Hello! I am new to the visa journey. And I hope I'm not asking the same question again. However, what do you mean by being a US citizen you can expedite the I-130 process? I thought it doesn't make a different in processing time if you are a citizen or not. Can you elaborate to me?

assume I am LPR, can I ask for expedite at VSC/CSC and if granted then expedite at NVC as well.

the criteria for expedite are

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

I suppose one can always ask.... I imagine it would have to be a compelling case to get to the front of the line... some people have been waiting a very long time and might be upset.

Most expedite cases are done for I-129 petitions for workers......as far as getting an expedite for and I-130 and/or I-129f

it is highly unlikely except for Health reasons or maybe Humanitarian situation.

I think what i wrote earlier was misunderstood. Being a US Citizen has nothing to do with whether or not they grant an expedite request. It DOES however pretty much guarantee that you won't be part of some government "quota" like LPR's. With that being said it makes sense that a adjudication officer will wonder "why would a LPR want an expedite request if there is no visa available to him right now anyway"... Do you understand?

It seems to me if his expedite request is approved at VSC/CSC then it will automatically be approved at NVC. If that is not the case then he could send expedite request to NVC as well.

  • 2 years later...

So if I am understanding right from your comments is that LPR can also request for I-130 exepedite. My husband's citizenship is in the process at present. We are hoping that in few months he will become citizenship. My I-130 is pending

Can we still request for exepediete on humantrian reasons? I understand that we still have to wait for him to become citzen etc but I think it will speed up the process for NVC and UCIS.

Any suggestions?
