We mailed our AOS package in May, including the I-485, I-765 and I-131. We included a check for $1,010. A few weeks later we received the attached rejection letter stating that the check amount was incorrect. I called the USCIS and they confirmed that the $1010 was the correct amount ($930 application fee plus $80 biometric fee). They told me to resend the package and check exactly as it was and include a cover letter explaining that the rejection was in error. I did this and also included a copy of the USCIS Fee Schedule taken directly from their web site. I sited the attached fee schedule in the cover letter and circled the fee amount.

A few weeks later we got the package back, again rejected with the exact same rejection letter and no additional explanation. I called the USCIS again and once again they told me the fee I included was exactly correct and I should just send it back. Not happy with this reply, I asked to speak to a supervisor. The supervisor told me that we should send it back with only the $930 fee. He said the biometric fee was not necessary since we already had biometrics done during the interview process in Manila.

I am skeptical. Everything I read here in VJ and on the USCIS site says I need to send $1010 for the fee and biometrics. I am afraid that if I send the package back with a $930 check, it will just be rejected again.

DEfinatley you have to do the biometrics even though you just had checks for the visa.

We sent separate checks. Maybe including a check for AOS and a check for the biometrics?

Hopefully third time is the charm. (F)

Sorry to hear about this....This same event happened to a friend of mine. He resent the AOS 1,010 payment a second time and it was accepted. USCIS was at fault. But, they didn't apologize, and they had to start over from from the second acceptance date. Good Luck to you both!!!

I forgot to mention that he mailed a personal check for 1,010 the first time. The second time he sent 2 separate money orders $930 & $80.

hmmm, now after reading the fee schedule again - dated July 2007 - I see there appears to be a seperate fee for the I-765 ($340), I thought it was ALL inclusive ($1,010 for the I485/I765/I131) :unsure: I hope this can be placed to rest - soooooon - I also read here at VJ that it was ALL inclusive when you file for the AOS.

hello,

I read the same story on VJ, but it was a problem of date of birth of the applicant.

She does an error on the form (date of birth, so the fees was less than 1010 usd) and the computer didn't understand what happen and reject the forms.

Sometimes we can ask ourselves if there are humans behind the computers :unsure: .

Maybe you have to review the copies you send to find if your rejection is due to an error like that.

Send two separate checks for AOS fee and bio fee. That is the safest thing to do. USCIS will return the $80.00 check in case it is indeed an excess. It happened to us. When I applied for my EAD, I put 2 separate checks for EAD (340.00) and bio fee (80.00). What USCIS did - they just returned my 80.000 check with a rejection letter (of the fee), and a NOA1 for my EAD. So I got the check back, and my EAD process proceeded unharmed.

Adjustment applications and ancillary benefits – The new application fee for an I-485 is a package fee that includes associated EAD and advance parole applications. Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications.

hmmm, now after reading the fee schedule again - dated July 2007 - I see there appears to be a seperate fee for the I-765 ($340), I thought it was ALL inclusive ($1,010 for the I485/I765/I131) :unsure: I hope this can be placed to rest - soooooon - I also read here at VJ that it was ALL inclusive when you file for the AOS.

The correct fee for the forms up to and including the I-485, EAD and AP is $1010. Unless you are filing for something else in addition, you've sent the correct fee twice.

Facts are cheap...knowing how to use them is precious...
