Firstly here is a brief background:

We got married in November 2005 but I wasn't eligible for applying for citizen until May 2007. During which period she's been using tourist visa to enter US several times. In her last entry (Feb. 2007) she was warned by the custom guys that she can't use tourist visa to visit US so frequently. She has stayed in US and not left since then. Finally I got my citizenship in February, 2008 and immediately filed my wife's AOS.

On July 23rd, in our interview the officer questioned my wife's use of B1 visa, saying that it's not the purpose of B1 visa. But we said at that time she didn't have any other kind of visa to enter the US because I was only a permanent resident. And the key point is that every time she entered, she didn't lie about her purpose. She always told the customs that she came to US in order to stay with her husband.

The officer said even though we had no other choices, but entering on a B1 visa is still a misrepresentation of the purpose of a visitor's visa, but as long as they find the proof that she didn't lie about her status when entering the US, we may be fine.

He added that he is a "new guy" in the office so he can not decide on our case. He needs his superviser to make final decision. They should be able to make the decision later that afternoon or tomorrow (July 24th) and send us the results in letter. Also he is going to have a 7-week vacation starting July 28th but somebody else supposedly will pick up the case.

Problem is, one and a half week has gone by, we haven't heard anything back from them! The town that I am living in is only 20 minutes away from the USCIS office, so mail delivery time should be only 2~3 days at most.

I checked the USCIS online case status and found that our case was "touched" on July 28th but no updates on the details.

Now my question is:

1) Are we gonna be OK?

2) I already scheduled an infopass at that office next Wednesday(August 6th). What should I ask? Can I get a clear answer of where our case is at?

3) Besides infopass, is there any other way I could get to know more about our case status?

Don't know how many people had this kind of experience. Please help us thanks!!

Its only been 10 days, I think you are freaking out way too soon! We waited for around 3 weeks before we rec'd the email that the GC was to be produced.

I doubt the infopass is going to tell you anymore than you see when you log into view your case. They'll tell you it can take a couple more weeks and to be patient.

I am in the same boat, we got interviewed on 7-30-08 and they didn't tell us at the interview if we passed, so we are just sitting around waiting. so dont worry you are not the only one. I have heard lots of officers do this ,where they wont tell the interviewee if they passed or not, some kind of sick power trip I guess.

I agree that you are freaking out way too soon. Give it up to a month. Then infopass.

If they didn't tell me if I was approved, it would be natural for me to ask. Did you ask if you were approved or did you just say goodbye and left?

I agree with that, I don't see the harm in asking unless they say they need to review your file.
