i dont know if anyone else has stated this cuz i didnt read all the reply s but if she comes now and u get married there is gonna be real problem most likely cuz u will be accused of visa fraud and she can get banned from the USA........i dont know for how long but if a immigration told her that u can bet there is a note in the computer that will pop up when u file if u dont get a visa first now.......

If you file a K1, there is nothing that says she cannot come to the US. There is a possibility she could get turnned away, but with Canada, I doubt it. And you can file now, you do not need to wait for her to return to Canada.

If you were PLANNING to get married while she was here on visitor status, that is visa fraud.

if we did get married and filed for aos would what customs told her make a diff?

Could be that by now the customs officer made some sort of note on her file - about warning her. so what do you think?

Yes, it does. For an enforcement officer to tell you you can't break the law certainly seems "allil (sic) god like." I mean that would be like a cop telling you you can't exceed the speed limit when you drive! Where do they get off, thinking they have these god like powers to enforce the law! I'd get married, then report that officer for informing you of the law! But I'm not a lawyer so you better check that first.

What kind of explanation is this? If you exceed the speed limit and get caught, you will get a ticket. Not to mention that fact that is dangerous to yourself and others. How does doing his job, make him the bad guy here? He's just enforcing laws that are already on the books.

People before us who toe the line on all the laws and/or blatantly break them are the one's to blame in all these situations. You know how easy it used to be to get visas? Then the fools rushed in and broke all kinds of laws and this stuff is what we are stuck with today. I'm tired of everyone blaming all the people who have to enforce the laws. They are just doing their jobs. Yeah, it sucks what we have gone/go through and yeah, sometimes those who are supposed to uphold the laws don't have scruples. But, for the most part, it's not their fault all of the time.

and u never know u might be one of the lucky ones and get noa1 and 2 before she goes back to Canada so all u have to do is wait for the interview after that good luck and happy to hear u r not going to take that big of risk

I know that wasn't the answer you wanted us to give. And, I'm sorry it couldn't work out so easily. But, I think doing it the legal way is the right way to go here. In the long run, it will save you a lot of headaches and more time apart.

I agree with all these VJers.

If you are saying that you were planning to marry on a B1/B2 visa , its of course against the law.Coming on a B1/B2 visa and then deciding to marry later is rightful and with the AOS law.Now as i can understand they have stampyo go back and ed at the back of I-94 as "NO AOS/COS/EOS " . Now you can marry but she has to go back and you can apply for K3.But you cant apply fo r AOS while she being here.Tha t wd surely lead to denial and ban.

Thing is she may may told that she is coming to visit friends but the PO officer may have suspected after talking to her.Thats why he stamped it . I also came in B1/B2 visa but i came in a project with my wife and to help her to apply for K1.But then she had to have to knee surgery and we decided to marry here after we found out it cd be done and so we did.So there was no preintention. We will apply in Mid aug. But believe me if you have that stamp and instruction , its best for her to go back and apply K1 or get married and apply for K3 after she goes back.

That's the real issue...what gave the officer reason to warn her...she must have either said something or had something suspicious on or with her. These people can be azzes that's for sure, but they don't just pull something like this out of their butt either.

To the OP...what do YOU think the reason this officer warned her about getting married and filing AOS?
