I have a question for all of you out there, my friend got a lawyer to do thier permanent residency papers, and he only filed the I-130!!!! And it's been pending since March 2008, .............

so can he send in the I-485, and I-765 now???? Or does he have to wait until the I-130 is approved. If he sends it in now, could he fill out a new I-130? And could he cancel the other one?

or attach a copy of the receipt of the one that is pending to the AOS?>.... What can he do?

Received Biometrics Appointment Notice in mail *April 1, 2008*

RFE for I-693 *April 9, 2008*

Biometrics Appointment *April 15, 2008*

RFE sent back *April 18, 2008*

RFE and case resumed *April 24, 2008*

EAD card production ordered *May 19, 2008*

EAD came in mail *May 29, 2008*

Applied for SSN "waiting for USCIS verification" *May 30, 2008*

Received Social Security Card *June 28, 2008*

AOS Interview in Atlanta *July 22, 2008*

Yes can file I-485 now if they have I-130 NOA1 letter, attach a copy of I-130 NOA1 to the I-485.

The I-485 is based on a pending I-130 that when approved would result in immediate relative visa.

So I would choose "a" on the I-485 form under eligibility category??? And if so, should I write on there "I-130 pending, see attached NOA1? An dhte NOA1 is the receipt correct? So I would send a copy of that with it and send it to Chicago just like a normal AOS packet?

Would they have to get the I-130 that is in the Vermont Service Center right now by the way (Although the Service center that covers our area is the Missouri Service Center) sent to Chicago or Missouri....

Do you know anyone who has done this before?/??

Yep, check "A" and attach copy of I-130 NOA1, and send to Chicago, just like the I-130 AOS guide.

And keep in mind that you can apply for AP and EAD with AOS at no extra fee. it's worth the paperwork.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship

Corect file I-765 along with the I-485, base the I-765 on the pending I-485 and use code (c )(9 )
