I hope someone out there can help me. I was married in Peru 2 years ago and the woman just took off and I have not heard from her since. I have since met another …sane .. woman and want to apply for a fiancé visa. Does the US consider my marriage in Peru valid? I've tried to track this person down to try to get a divorce but I believe she is in Columbia? I don't know what to do..any help will be greatly appreciated!

You betcha the US considers your prior marriage valid. Married is married. You'll need a divorce before any petition is filed.

You betcha the US considers your prior marriage valid. Married is married. You'll need a divorce before any petition is filed.

Ditto: You need to be free to marry in order to file an I-129F, so will need proof that the prior marriage was terminated.

Forgive me ...Not sure what that is can you explain??

File for divorce without her presence. If you can demonstrate that you have made reasonable efforts to locate her (consult a licensed attorney), you may be able to proceed. In states that have grounds for divorce (not no-fault states), abandonment usually works. You probably don't have to actually find her.

NO, :no: you can do this in the USA at the nearest divorce court, consult a lawyer on this.

File in the state where you live. You have her served by publication in the newspaper.

See an attorney to file and for the affadavits required for service by publication. No need to find her.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
