I filed the I-130 in July 2007 and from that date until January 2008 I kept calling USCIS because even though my money order was cashed, I never received the NOA1. No one could find my application and they kept telling me to give it more time because of the number of applications they received due to the fee increase. In January, one of the reps suggested that I start over instead of wasting any more time, which I did in February and paid again. Lord behold, I just received the NOA2 for that old app, it has been approved with a notice date of July 17th 2008. A year after it was received, so now what?????? How do I cancel the other one? will I receive a refund? I chose not to request a refund when I reapplied because I certainly didn't want to give USCIS a reason to hold my application any longer than they usually do... Any advice will be helpful. Also how long does the NVC processing take in average? Thank you all for your help.

Isn't it funny how they manage to take your money but can't find the damn paperwork! Since you are taking the K3 route, did you receive approval for both the I-130 and I-129f???

I would just run with the approved petition because I would be scared that if I emailed them to cancel the petition you sent in Feb 08, I'd be worried they'd stuff it up and cancel the wrong one. You would also wonder whether they would go ahead and approve a couple's petition for the 2nd time if they already had an approval for your names.

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter

i guess it goes to show that they just throw our petitions around, leave it messed up on the floor, put it aside and then they forget about it.

sept. 26, 2008----got case # from a live operator

oct. 6, 2008 ------received AOS bill/paid online

oct. 7, 2008 ------shows PAID

oct. 14,2008 -----IV fee generated/ paid online

oct. 15,2008 -----shows PAID

oct. 16,2008 -----mailed DS230 overnight

oct. 23,2008 ---- RFE

nov. 3,2008 ----- case complete

nov. 26,2008 --- medical exam

aug. 14,2009 --- remedical finally, passed

aug. 24, 2009 -- interview , passed

aug. 29, 2009 -- visa in hand

sept. 24, 2009 -- POE LAX

Congratulations on the approval..

I would just grab whatever approval I have and go ahead with that, since you are at Vermont, it will probably take a few months before they get to the one you filed in Feb 2008. Until that time comes, they won't even know you have a second petition. I would not cancel anything right now, just in case they cancel the wrong one! I would probably send them a letter explaining the situation, out of courtesy, once the visa is in hand.

I am cracking up at the refund part! You won't get far with that. Take it as a lesson learned and run with your approval.
