sorry to repost this but no one had an answer so i thought i may have submitted it in the wrong forum!

hey everybody !

just a quick question that im confused on!

my fiancee the USC was married before and has been divorced for about 2 years now!

she was born anderson, and thats is her name in her passport now and thats what she goes by now! .. but her marriage name was roberson. so will we have to show proof of a name change? for the I129f.

or the fact that all the info we are using to prove she is a USC, says anderson we will not need to show any proof?

also when we send the divorce decree off what part of it do we photo copy as apparently its 50 pages long? i dont think she has the certificate!

Your fiancé can always request a divorce certificate from the county the divorce took place in. If he's not in the same town anymore, many states allow you to do so online. I got my birth certificate this way (the county records, including divorce certificates, were all available) - and I found the right site with a simple Google search.

As for the name change, your fiancé will need to show proof of name change - so this could be done with a marriage certificate showing the first name change and also the divorce decree or certificate that shows the legal changes. I'm pretty sure it explains this in the guides here if I remember correctly. Have you read over them? They're really great.

I had to call the county courthouse, request information, send in some money, and they sent it to me. It was like $8 or something reasonable.

She HAS to have that divorce decree to prove she is free to marry you. Have her get that soon. It's really not a big deal to do.

All Other Names Used (Including names by previous marriages)

You will need to supply them with all names used. You prove the name change by including a copy of the certified marriage license from the County in which she was married. Also include a copy of the certified Decree of Absolution to prove she is divorced.

You do not need to copy all 50 pages of a divorce decree. You need to request a certified copy as you've been advised above. You then (actually she does) submit a photocopy of the one or two page "certified copy of divorce decree".

If she got her divorce in Texas (im guessing she is since the local service center is TX) they have to send in the whole thing since they don't give any short certified copies.

SOrry to kepp asking so many questions but im trying to sort it out from england as jess is really busy at the moment and its hard to get time for her to answer my questions

So i take it that if she has a decree that is 50 pages long it must be the cetified one !

does the birth certificate and marriage certificate need to be certified?

You're required to send in a photocopy of an original. Ie, the sort that's official/registered with the proper authorities -- the same sort you need if applying for a passport with your birth certificate, or if you're adding a spouse to insurance with your marriage certificate, etc. The copy itself does not have to be certified; a regular photocopy is fine.

I googled, and it looks like wowswift is right -- there's no substitute for the divorce decree in Texas. Bummer to waste 50 pages of paper. :(

Here's some official Texas info but it doesn't help that much. http://www.dshs.state.tx.us/VS/reqproc/faq/mardiv.shtm Divorce records come from the District Clerk's office of the county. She call call them and ask if there's anything shorter.

Birth certificates can be ordered online now. http://www.dshs.state.tx.us/VS/reqproc/certified_copy.shtm

I have 3 old copies of my Texas birth certificate, but they all have a place where the county clerk signed and dated that it is a certified copy...just a little stamp on the side, not a separate paper. It also has one of those impression marks with the seal of the county. She just needs to photocopy the birth certificate for sending in. One of mine has a back side, one doesn't, and the other (since I was born before dinosaurs and apparently Xerox) is some kind of micofilm print I suppose. But they are all certified copies. I don't know what the new computer age copies look like.

With all that copying, I'll pass on a life-saver to me getting organized. I bought a new HP all in one printer, scanner, copier, fax. That made life so much easier because there's alot of copying to do. Beats hauling stuff back and forth to work or even worse Kinkos where you have to pay. I would think of something else needing copying and I could just do it in my jammies at midnight when I thought of it. I should have thrown out the old printer and separate scanner a long time ago. Maybe she already has one, but if not, think about getting one because there's still more paper work to come like Affidavit of support, AOS, EAD, AP, XYZ. LOL :lol:

50 pages sounds a lot for the Decree Absolute. Is that just the Decree Absolute, or is that including the Petition, Decree Nisi and the rest of the stuff?

In the UK the Decree Absolute is a fairly simple document which states that the marriage is dissolved on such-and-such a date.

To get a copy of the Decree Absolute all you need to do is request one from the court that dissolved the marriage. You need to send them the case number - will either start with **D (*this is the last two digits of the year petition was filed, or two letters and then the **D) and a cheque made payable to HMCS for the princely sum of £5.00.

My other half had to send for a copy of his divorce decree from Florida. He got a certified copy back and it was 11 pages long. However there is no raised seal only a stamp. I suppose they vary from state to state. Also whats the difference between a Divorce Decree and Decree Absolute or are they the same thing?
