Hi All

I received this email in response to a request for an interview.

Embassy records show that your application was terminated on March 25, 2008. K-1 visa applications are kept open for one year only. If you wish to travel to the U.S. to marry your fiancée and reside there permanently, your fiancee will need to file a new I-129F on your behalf.

Thank you for your e-mail correspondence.

Has anybody got any ideas to try and re-activate the previous application?

I think a new petition would be faster than trying to reopen one that is almost 1.5 yrs. expired.

What caused the petition to sit in London for over a year?

Is now a US Citizen immigration completed Jan 12, 2012.

I had my medical last June, in London. And passed. And I knew that I had to return to London for the interview.

I have been working and living south of Cancun for the last 18 months. I guess that we are lucky, Renee visited me 15 times last year and I've been to the U.S. several times.

It's been a VERY expensive 2 years!

Now we want to move on and it appears we cannot. Unless they re-open the file, or we re-apply. Re-application seems like a waste of time, for everybody concerned. Nothing in our situation has changed since March 2008. Just a bit older, that's all.

So, the file was active until March 25, 2008.

Any ideas, anyone?

The file was returned stateside at that time. Did your fiancee receive a Notice of Intent to Deny? They may not do that anymore. Your fiancee should probably contact the USCIS to see where the case file is. I still believe that $455 and 6 mos. for a new petition is probably quicker than trying to get this one re-opened.

But it seems like a lot of wasted effort and no follow up on the first application.

Before a visa can be applied for the USC will need to file a new petition. I'd include a letter explaining why a second petition is being filed.

Fighting City Hall/Consulate just isn't going to work here.

Facts are cheap...knowing how to use them is precious...
