Hello,

I've already sent off for the IR-1/CR-1 visas for my wife and step-daughter and waiting to receive the NOA1; I am debating on whether or not going the K3/K4 visa route. I have read about having to file an Employment authorization form and possibly some other forms along with additional fees with the K3/K4 visas. I am curious as to if we could wait on their IR-1/CR-1 visas to get approved before she gets a job to avoid that extra paperwork and fees or would we still need to file and pay for those authorizations after the IR-1/CR-1 visas are approved before she gets a job? Thank you for your responses!

Did you send two separate I-130s for your wife and step daughter?

If you want her to be able to work immediately without extra paperwork, then stick with CR1/IR1, do not file K3/K4.

CR1/IR1 interview has to be at the consulate.

If they enter US with k3/k4, then their I-130s get forwarded to NVC (it doesn't always happen) and you followed up with fee payment and docs submission at NVC, then they have to go back to Thailand to attend the CR1/IR1 interview.

07/24 NVC approved expedite request

US Consulate

07/31 Package arrived at US consulate

08/01 Was told to pick up packet 3 on 08/04

08/04 Req packet 3 send by mail.

08/09 Received packet 3

08/11 Returned packet 3

08/15 Picked up packet 4 & medical check up

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

CR1/IR1 visa holders do not have to file for an Employment Authorization Document since their status allows them to work right away. No additional fees are needed either once they enter the country. If you think you can wait a little longer for their CR1/IR1 visas to be approved then that's the way to do it and not have to go through the AOS process which can be costly and time consuming.

All things being equal, I would plan on the CR-1/IR-1 taking 2 to 4 months longer than the K-3/K-4. Since EAD takes about 2 to 4 months, she would essentially be able to work in the US at the same date in the future. It would cost more, but you would be together sooner.

If you want her to be able to work immediately without extra paperwork, then stick with CR1/IR1, do not file K3/K4.

CR1/IR1 interview has to be at the consulate.

If they enter US with k3/k4, then their I-130s get forwarded to NVC (it doesn't always happen) and you followed up with fee payment and docs submission at NVC, then they have to go back to Thailand to attend the CR1/IR1 interview.

Thank you for the reply, well I am in kind of a hurry with my wife and daughter coming here due to housing and not wanting my daughter to fall behind too much in school. What is the AOS process?

AOS is simply applying to change the immigration status from, for example K-3, to permanent resident.
