Hi friends!

I live in Canada and my fiance Antonio applied for the k1 visa for me to come over to the States. We sent in our package 129f and received out noa1.

Are there any other forms, such as work authorization or anything else that we should be sending to be approved as well? Or is the k1 visa all we need to be doing right now? Thanks so much!

Cindy :)

Hi Cindy! As of now nothing else is needed in addition to your K1 petition package. You might want to start reading the guides about embassy and Adjustment of Status (AOS) from K1 to get the picture as what will be your next steps. I found VisaJourney guides really helpful! Best of luck and lots of patience while you two wait for the approval!

Work authorization is for you to apply when you arrive in the US and would like to work here, no need to apply if you would not work. So, I think if you completed K-1 Visa, that should do it. My K-1 Visa used to expire for 3 months (it was 4 in 2004), and we got married within that day, after that apply for I-485. Good Luck.

You can apply for EAD immediately upon entry but the card can take 60-90 days to receive and your initial work authorization after entry is only 90 days. Do you see the conundrum?

After marriage you will apply for AOS & EAD & AP.....

YMMV

Hi,

Before you can deal with any of these things, you will need to get your NOA2, go to an interview, get your visa, and then enter the USA.

You've got a long way to go before you even think about your EAD. What you've done so far is good, now you just need to wait. You can print out all your forms for the I-485 (AOS) and get started on those as soon as you enter the States. Just my two cents.

In the meantime, start doing research on what happens in the Embassy phase. Go to the Forums page and look that up (Embassy). Also, check out what happens at the Canadian Embassy interview by going to "Embassy Info" at the top of the page. This phase has a lot of paperwork to do too. Start there and then worry about the AOS stuff when you get here.

I could only deal with all of this info in pieces. I didn't even start AOS stuff until David set foot in the USA.

Good luck!

Saludos, Shannon
