Need advice urgently! I am in Brasil with my wife and son. We are suppose to return back to the U.S.

and she absolutely wont return back with our son who has dual citizenship. What should I do? go to the American Embassy for help? contact a lawyer in Brasil ? Its a very bad situation, she had planned not to come back to the states with our son after looking at all the personal items she had packed in her suitcase. Our son is 2.5 years old and has much better living condition in the US than Bahia Brasil, this is not a good city to raise a child. Lots of crime, murders, lots of very under educated people in this city unfortunately Please, any advice I would be grateful. I am in a small town alone in a hotel, I thought it would be better to leave her house to sort things out for my self. Thanks

AOS Process a fading memory...

01/31/07 - Mailed AOS/EAD package for Olga and Anya

06/01/07 - Green card arrived in mail

Removing Conditions

03/02/09 - Mailed I-751 package (CSC)

03/06/09 - Check cashed

03/10/09 - Recieved Olga's NOA1

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

Her and your son will be staying in Brasil?

Yes, she wants to stay and live in Brasil with her family and our son.

sounds like his wife is intent on leaving him and taking their son with her to reside permanently in Bahia - and as they are already out of the US, (with hte USC as well currently there) I don't know what his legal standing is...

I suggest that you see a lawyer...in Brazil.....right now. Also inform the authorities.

I am so sorry for what has happened, but the child is a US citizen and has been abducted by one of it's parents. I don't know what the laws are in Brasil, but the embassy will be able to get you started on whatever you need, or can, do now.

No, she wants to stay here in Brasil with our son together.

Have you been residing in Brasil together? Was the child born in Brasil, or did you just go there together to visit family?

That and the suitcase kind of gave it away for me. Where there's no travel, there's no suitcase. Apparently she ain't packing a suitcase to travel back to the US so he must refer to the suitcase she packed when first travelling to Brasil.

i'm not sure about brazilian law but .... in the US, without an existing legal custody agreement, the parent who has physical custody of the child - has custody.

personally speaking, i would take my child and return to the US, especially if my child was born in the US and only was brought to a foreign country for a visit. at this point, i'm sure it will be impossible for you to get your child alone.

I am sorry I have not made my self clear. We traveled to Brasil January 12, 2006 and have return tickets for March 12, Although she has informed me that she and our son will not be returning to the states and will be living with her family. Our son was born in Brasil, his birth was recorded at the state dept and holds American citizenship. He is 2.5 years old and has lived 2 years in the states, making his habitual residence in Ohio. After looking at his mothers suitcase this was a pre-planed oneway trip.
