Hi everybody.

Please if anyone of you can help us will be welcommed.

We met in 2005 she's american and i am italian. After many travel we decided to prepare for a life together.

We do not have a clue on how to make it happen.

I am actually living in Italy and she live in the US. We would like to move together to the US.

We would like to know what is the best and easier way.

For what we read the best is the CR 1 visa.

Some questions:

- Can i go in the US on a tourist visa and marry her there then go back to my homecountry and prepare all the forms? I cannot stay in the US without work. I need an income because i am paying already a mortgage in Italy.

- Do you suggest to have a lawyer? We checked out some but they are really expensive. (300$/h).

- Is the CR 1 the best one for our situation?

Fastest?

Get a K-1 (4-12 mo), prepare an Adjustment of Status packet while it is pending, get married when you arrive in the U.S., apply for Adjustment of Status immediately, get your EAD within 90 days. Start working.

Save up money so you can live for that 90 days without working. Mind you, nothing stops you from searching for a job during that time.

If there is anything weird about your case, get an attorney. If it is straight forward - you should be able to do it yourself. If your fiance/wife gets an attorney in the U.S. she should be able to do the K-1 for under $1000 and the AoS for under $2000 PLUS filing fees on both.

You need to be married to file CR-1.

If you decide to go to the US to get married with a tourist visa or VWP, you have to leave the country and your wife start the paperwork.

If i could get a work permit while i am still in Italy i could have my company moving there. The problem is they do not give a sponsorship to anyone but if i have a workpermit they can find me a job in the US.

I cannot stay 90days there hoping to find a job.

I would prefere to go in the US with a work permit so i can have a job right away

You may want to consider the DCF (direct consular filing) if your future wife qualified, it's the fastest way of getting you a CR-1 visa and you are able to work in US right away. But, you need to be married before you can file CR-1 the DCF way.

Try avoid having to deal with USCIS, we regretted we didn't do DCF before my husband went home and ended up being separated for a long time.

with CR-1, you can look for a job right away.

You need to be married first.

CR-1 takes about 9-12 months to process right now.

Some consulates required 6 months residency and/or work permit at that country in order to qualify for DCF, some do not required that.

If you need a work permit when you enter, you need the CR1. There is no fast way. We all here want the same as you and to be with our spouses right away, but this is all you can do.

If she has permission from the Italian authorities to reside in Italy, you provide that documentation. Otherwise, she files the petition stateside. Check with the Embassy in Rome as to their DCF requirements. In all likelyhood, by the time you can marry and establish her residency, you could be well on your way to an immigrant visa.

If your priority is to work right away upon arrival, the CR1 is your way to go. It's your choice where and when you marry but you must marry before she files the I-130.

When we file i have to go back home and not gop back to see her until the process is ended?

Where will i have the interview? I mean Italy or US.

Do we both have to attend the interview in the same place?

Guys are being very helpful.
