Does marriage need to be conducted in US for fiancee visa

Not sure if this has been posted before but I had a couple of questions that I hope someone can answer for me.

1.) Would there be any problem if me and my fiancee get married in her country before getting the visa ?

2.) If not would it be okay to get married in her country after she receives the visa and then we both travel back to the US together using the fiancee visa?

pretty sure the entire point for a K1 is so that you guys can get married in the US. If you want to get married in her country you would have to go through a K3 I believe.

(05/24/08) - Arnold proposes to Ashley at the Riverwalk, how romantic! Ashley's 19th birthday.

(06/09/08) - Arnold's 18th birthday.

+(06/18/08) - NOA1 received by Ashley

(06/25/08 - 08/19/08) - Arnold visits Texas for the first time! Yeehaw!

(07/05/08) - Arnold is turned down by Ashley's father when Arnold asks for his permission/approval to ask Ashley to marry him.

+(10/14/08) - NOA2 Issued

+(10/21/08) - NVC Confirmation Issued

+(10/22/08) - NOA2 Received by Ashley

+(10/23/08) - NVC Confirmation received by Ashley.

+(11/11/08) - Packet 3 Recieved by Arnold. So close, I can almost taste itttt~

(12/18/08 - 01/06/09) - Arnold and Ashley's first Christmas and New Years together in Texas <3

(02/12/09 - 02/16/09) - Ashley visits Arnold in Canada for Valentines Day and Family Day.

(03/13/09 - 03/22/09) - Ashley visits Arnold in Canada for Spring Break :3

+(03/31/09) - Packet 4 Received with so little runway.

+(04/08/09) - Arnold's Interview date!!!

(07/10/09) - Arnold arrives in the US

~(08/14/09) - Marriage in Austin, together at last!~

You need to read the guides if you don't even understand what a K-1 Visa is.

a k-1 visa is a visa allowing the beneficiary to come into the US with the purpose of marrying the petitioner.

1) No you and your fiance may NOT get married in her home country and then apply for a K1.

2) Once again No. You MUST get married in the US. This is the whole point of the K1 Visa, for her to come to the US and GET MARRIED in the US.

Not sure if this has been posted before but I had a couple of questions that I hope someone can answer for me.

1.) Would there be any problem if me and my fiancee get married in her country before getting the visa ? Big problem. The K1 visa is so that the foreign beneficiary can enter the US for the purpose of marriage.

2.) If not would it be okay to get married in her country after she receives the visa and then we both travel back to the US together using the fiancee visa? Getting married outside the US nulifies the K1. It is for fiance(e)'s not spouses. If getting married in your fiancee's country is important then you may want to look into the K3 or CR1 visa.

The primary terms of the K1 visa are.

1. Arrive in the USA unmarried.

2. Marry in the USA within 90 days of arrival or leave the USA.

If you marry before arrival or leave to marry elsewhere, you are no longer a fiance and must begin again by filing a petition for a spouse visa.

Your next step after marriage is to adjust status to permanent resident. In order to do so, you'll need to show a marriage certificate for a marriage in the USA.

What many people do is hold a celebration of some sort for the family before departing the foreigner's home country. The best time to do this is after the visa is in hand, IMO but the legal marriage must occur in the USA to avoid starting over again.

Facts are cheap...knowing how to use them is precious...
