Name Change Options Before Applying For AOS

Hello,

I have a little dilemma, I got married week and a half ago and have just received the marriage certificate. I will be changing my last name to my husband's.

1. Should I go to the SSN office and apply for a new card with a new name?

2. Should I use my husband's last name on all of the AOS forms?

May 16 - Sent to Chicago Lockbox

May 21 - Received in Chicago

May 25 - NOA1s issued

May 30 - NOA1s received for AOS, EAD, AP

June 26 - Case transferred to CSC

July 26 - Biometrics Letter received

Aug 12 - Biometrics Appointment

Aug 12 - AOS touched

Aug 30 - EAD card received in mail

Oct 06 - RFE (need medical and vaccination) ;(

Oct 31 - Card production ordered

Nov 01 - Welcome notice sent

Are you the USC or the foreign spouse?

1. Either way you need to go to the SSN office, but if you are a foreign spouse you need to have a SSN card issued already.

2. If you are the foreign spouse, the name that you fill out the USCIS forms with, it's the name that's going to appear on your green card, don't think USCIS is going to say "ohhh they got married I guess she wants to adopt her husband's lastname" you have specify it by yourself. :)

In case you are the USC, there is no problem on which last name you use, since you will be submitting proof of citizenship and marriage certificate they can do the math on this case.

I'm sorry, yes I'm the foreign spouse :innocent: and I do have a SS card already.. So do I put my new last name on all of the documents from now on? Is this OK even if I do not have any other documents proving I've changed my name? Or do I have to go to the SS office and get a new card with a new name on it?

You can go ahead and fill it out using your husband's last name, you have your marriage certificate to prove it. You NEED to go as well to the SSN office and show your marriage certificate to change the last name on your SSN card.

Timeline

The fact that you are married and are opting to use his last name as yours - is enough. Start using it and get your greencard in the new name and get your SSN card changed also. The documents don't decide what your name is - you do. Good Luck
