Can my fiancee get a passport while case is pending?

Hi guys, im new here!

My fiancee recently got her passport in the Philippines. I was wondering if that will affect our petition because I hear things like she has to get it after being approved and there are strict guidelines that we must follow? Will that affect our case? Our case is still pending. Thanks!

December 2007 & January 2008 - Visited her in the Philippines

January 1, 2008 - Got Engaged

January 15, 2008 - Sent I-129F

January 18, 2008 - Received

February 13, 2008 - NOA1

February 15, 2008 - Check Cashed

June 25, 2008 - NOA2!!!!!!

June 28,2008 - NOA2 Received!

July 11, 2008 - NVC received petition

July 14, 2008 - NVC sent petition to the Embassy

July 17, 2008 - I received NVC letter containing my MNL number

July 18, 2008 - U.S. Embassy receives petition

August 4-5, 2008 - Medical

August 6, 2008 - Paid DV

August 15, 2008 - Interview PASSED!!!!!

Sept 11, 2008 - Visa in Hand!!!

Sept 27, 2008 - POE in Honolulu!

I am not sure how it could affect your case - Until the US grant a visa, she is a citizen of the Phillipines and as such passports and such are between her and her government. My understanding is you have to present a valid passport for your consulate interview anyway to have your K1 visa approved anyway

Maybe you need to clarify with the person who told you this, and see if you can find out where they heard it from. But it really seems outside any experience I have heard off.

Never heard of that too. All I know is you can get your passport at anytime you want. I have mine and my kids if situation arises and its needed.

No, it won't be a problem. I have friends who have passports a year before they apply for a visa and they are in the US now :)

I don't think it will affect your case.In fact, the Embassy require passports to be valid for at least 6 months.

I don't think it will affect your case.In fact, the Embassy require passports to be valid for at least 6 months.

The Consulate requires the passport be valid for at least six more months after the visa is issued. The don't care if the passport was issued the day before the visa was granted.

For the OP, there are strict rules for the beneficiary imposed by the PI government and you'll need to follow them but getting the passport early is fine.

Facts are cheap...knowing how to use them is precious...

Not at all. I have a passport since 1995 which I kept renewing and I am here now in the USA under a K1 visa. Just make sure that her passport is still valid for 6 months from the date of issuance of the fiancee visa.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.
