Ok, we have bitten the bullett and submitted I-129F to Vermont CSC. :D

Package received today aftermailing from Melbourne AUSTRALIA.

Both of us reside in Australia as my fiancee is on a study visa.

Happy to answer any questions from aussies filing in USA.

Hey there,

My fiance is from Sydney and we are currently in that horrid 'waiting period' after sending our package off to the California Service Center. Fortunately, we have a great lawyer who has helped us out (and has been through the process himself with his wife).

Here's my concern...my fiance and I are planning on staying in the states for awhile, but eventually returning to Australia. Any information on how to go about fililng our marriage there? Thanks, J.

3/20/2006 - Sent in I-129F to TSC

03/27/2006 - NOA1 (from CSC)04/01/2006 - Touched

7/11/2006 - Received, filled out and overnighted RFE back to the CSC

8/17/2006 - NOA2 APPROVED!!!!!!!

8/21/2006 - Received NOA2 via snail mail

9/22/2006 - Found out U.S Consulate in Sydney mailed Packet 3 to my lawyer..IN VIRGINIA..and not my fiance. Argh. Lawyer overnighted information to me.

9/25/2006 - Received packet...got together additional forms to send to fiance in Australia

10/12/2006 - Send packet Express to Australia

10/19/2006 - Package finally arrives at Fiance's door. Argh It's taking forever!

11/29/2006 - K-1 Visa Approved!!!

12/17/2006 - He arrived in the states! I'm in shock!

2/24/2007 - Our Wedding Day!

4/14/2007 - Mailed forms for AOS and EAD

5/24/2007 - Biometrics Interview in New Orleans

6/22/2007 - AOS Approved!!

Not exactly sure as we have not really studied that option.

A good site to start would be http://www.immi.gov.au/

I would think it is relatively quick and easy judging by the 2 weeks it took to get a study visa here in Australia for my fiancee. Even a work permit was done within 30 minutes at a Dept of Immigration office.

We did not use a lawyer for student visa and did all of it ourselves. Infact, if memory serves me correct, you can apply for a student visa and possibly even immigrant visa online.

How about the background check deal? Any idea how long that takes or if it can be sped up? While it's a slim to none chance he'll be here in time for my graduation, we may be able to make it if we don't have to wait five weeks.

Whilst Australia recognises the actual US marriage, as the australian citizen I had to apply for a change of name certificate at the 'Department of Births, Deaths and Marriages' in order for my new married name to be recognised officially and for me to change my name in my passport etc.
