I originally filed in Dec but got the documents kicked back to me because I over paid.

I resent the docs begining of Jan and had biometrics done first week of Feb

we got the AP approved and sent to us during the first week of March.

Now coming upon May and haven't heard back from anyone. Is there an interview...how much longer do we have to wait? Anyone else still waiting or have some idea on how much longer this is going to take?

We're still waiting. Our last receipt notice was January 30th. I called them today to ask about the advance parole because it's outside processing times and we cannot check the status online because it says we have an invalid receipt number. The woman I spoke to was so RUDE and barely spoke English. She said that the reason the case isn't in the system is because it's too expensive to enter it into the computer. I also asked her when the advance parole may be processed and she just kept repeating, "They are working on the case."

And this was after I had been transferred to a "specialist" because the original person couldn't look up my receipt number in their system.

Check https://egov.uscis.gov/cris/jsps/ptimes.jsp and look up your local office for processing times. There is a lot of people who filed back in July / August who are still waiting to hear of an interview date or who were transferred and haven't heard anything. The processing times lets you know which date of cases they are working on and will give you an idea of how long you may have to wait. Though they seem to be going backwards. My date came current at the end of February and I received my interview notice a week later. Now though the dates have went backwards for those who are still waiting. The date for my local office is now the week BEFORE my filing date so i'm very lucky to have already had my interview.

USCIS received our application Jan. 16 .....101 days and nothing on the I-130 or the AOS....

Not nothing, you had your biometrics ;)

Blaine74 Blaine, since you came on a K1 you may or may not have an interview. You could also be transferred to the CSC. There is no rule, just be patient, it can take a while depending on your local office and your personal case.

They will only do something when your case is outside of the normal processing times (CB82 mentionned where you can check it)

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

my case is at the MSC (National Benefits Center) don't know why, we didn't file for the employment authorization.

Anyhoo....

according to that status website says Feb 05, 2008. so....does that mean apps received up until Feb 2008 are being processed? Because mine was submitted back in mid Jan.

it just seems weird that we had our biometrics AND app for Advanced Parole approved to quickly....but now takes so long for the AOS.

You actually go by field office. Everyones application starts at Chicago (where you mail it) then it goes to MSC. It may get transferred to California or it goes to your local office. Your profile says you're from Seattle. So assuming that is your local office, the processing times as of April 15th for Seattle is July 20th 2007. When your receipt date that is on your NOA for I-485 becomes current then it gets transferred to your local office where you will then receive a letter for interview (if it hasn't already been transferred to California where it may get approved without interview). AP and EAD are supposed to get approved within 90days. The AOS however has no set time frame of when it will get approved. Some people have been waiting for several years to get approved when they're stuck in name check.

Well, I was told the case is at the MSC, not at the field office....yet. So basically I have another "5 months" of documents to wait for? But then would take this case beyong the "6 month" period allowed. Our AP was approved within a 30 days. I just figured the AOS would be coming soon thereafter. But we are going on 2 months now. Gawrsh....I couldn't imagine having to wait years.

Yes so did we.

And no the 6 month is not accurate anymore.

realize that last summer they received more applications in 2 months than they usually do in a year or something of the sort.

Go to the June; July, August and even September filers threads. See all of us who are still in limbo and now looking into having to pay again to renew our EAD/AP because when some of us filed (before July 30th 07) the renewal fee was not included.

We all hope it won't take too long; but it does. People approved in 3 months are not a rule, they are lucky exceptions.

Check what your local office says. Nothing can be done until you get out of the normal processing times (or very little really).

AOS= You need a lot of patience.

I thought I could go back to see my family this year. It doesn't look like it. I originally though I would have an interview by January 08. I still have heard nothing.

Just be patient; and look around and realize there are people in far worse cases. I am not even one of them.

yeah, got lucky with the not having to pay for the AP. Thats why our application was orginally kicked back to us, because I overpaid by including the fee for the AP.

I called up USCIS and they told me to not bother them until 6months have passed. When it does, they would put it on some priority list or something. Sounded like hot air to me.

Well, our AOS reciept notice was on Dec 6th, did the biometrics on Jan 4th.
