Hi< i am new here> I am a U.S. citizen and my partner is from SA. We met a year ago when he was here on a work visa. He was suppose to come back this year but was denied for various reason nothing out of the ordinary. We have deceided to get married and want to file for the K-1 visa. Will him being rejected his work visa would this cause us any problems. We dearly love each other and was going to do it anyway, file for the visa. We just wanted to save more money and take our time. I did get to visit him for a vacation a few months ago, but I miss him so much.

Depends on why he was rejected for a work visa!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Should be no reason for denial of the visa as long as he has not had any prevuious overstays that would incur a ban. Applying for a visa to the USA does not mean you must put your life on hold. If you need to travel to another country for work or other reason you are free to do so.

What if he is working in another country and has to make contact with the embassy. That may be a dumb question, all this is new to me and I just want everything to be right. Thanks for input

hmm i would guess that depend how long he works in that other country... best thing about that subject would to call uscis and ask

He was rejected because he has worked here too many years in a row. Seems there is a limit. And also can we file for a k-1 visa if he has to go to work in another country.

What kind of work visa did he have? An H-1b? A J-1? If there is a two-year (or other period of time - I don't know what the limits for some of the other temporary worker visa types are) home residency, he may be able to get a waiver.

He is afraid if we apply for the k1 visa now it will looked like he tried to do something sneaky for applying for the work visa. But he has worked here for like 4 years in a row. We actually got engaged last year but was trying to save money for a great start and planned on filing for a k-1 after this work year. Him returning home to take care of things , he has a farm there. Any way it looks like that is not going to happen. So we have deceided to go ahead and file for the K1 .. any words of encouragement ????

You might face some additional scrutiny of your relationship bona fides but having applied for one too many work visas isn't a reason to deny a fiance visa. How much extra scrutiny depends on a number of things including the country he's coming from. So, profile details please.

Okay, as far as an H1-b is concerned, a worker is permitted to stay for six years maximum, and then must remain outside the US for a minimum of one year before another H1-b petition can be approved.

The thing to note about an H1-b is that the employer applies for it, not the employee, as it is job-specific.

How long has he been back home? It may even be that, with the time frame for a K-1 visa, the year might be over soon.
