AOS question.....

Good evening everyone

I'm planning to get married in Japan in May. My future wife will continue stay in japan after her contract with her job is finshed (AUG to DEC) and i will return back to hawaii, then she is planning to move from japan to hawaii after we've got all standard forms and interview finished...

The question is that when should i apply for ADJUSTMENT OF STATUS? Should i apply after marriage in Japan or should i apply sometime before she enters USA?....

If i have left anything out, please correct any mistakes or any details that may need to be added...

I believe you would actually have to apply for a K3 to get her into the country, then apply for AOS afterward. The K3 is the spousal visa, so you would have to apply for that to get a visa that would allow her to entry the country as an immigrant, and not a visitor. Then you would have to apply for the adjustment of status to make her a permanent resident, and be able to get a greencard to work and such. Someone correct me if i'm wrong, please

if you get married in japan you will have to apply k3 which is going to take 8 months to 1yr+ to get.She wont be able to get a visitor visa or anything (to visit you) while she is waiting for K3 in Japan. Once she arrives to US you will have to apply AOS to get her GC.

If you currently live in Japan you might be able to file for DCF (Direct Consular Filling). Check the guides to see what option suits you best.
