How do I include my fiancee's son in the petition?

Originally my son didn't want to go with me, so we didn't include him in the original K1 form we submitted in November 07, now he has changed his mind, and wants to go with me after all, by the way he is 17,

Does anyone know how to include him in the original petition?

Part B question 13 of the I-129F says list all children of your alien fiance. It makes no distinction whether they intend to immigrate. If your son's name appears there, that's all you need. If not, you'll want to notify the Consulate as soon as they have your case file, then arrange for a P3 for your son. If he won't be 18 by the time the visa is issued, you'll need either a court ordered full custody or a notarized letter from his father, permitting him to immigrate.

My daughter changed her mind too after I got my K-1 Visa, so I may be able to give you some information.

I need a little more information first. Have you had your K-1 Visa interview yet? Did you put your son's name on the I-129F application, even if you didn't indicate that he would be wanting a K-2 Visa?

Here's how our situation went:

I went for my K-1 interview on June 10/04. At my interview, only my daughter (at that time, she was 16) was eligible to follow-to-join. My two other children were too old. One of the people who I spoke with at my interview told me that I should indicate that my daughter may follow-to-join so that I didn't close the door on the possibility down the road. So, I did so, but still didn't think my daughter would come to the U.S. to live. My Visa was approved that day.

In early 2005, my daughter decided she wanted to come to the U.S. I emailed the Vancouver consulate to ask what I needed to do to start the K-2 process. They told me to fax Form DS-230 Part I to the consulate and to start collecting the necessary documents (such as police certificate, long form birth certificate, permission letter from her biological Dad giving his permission for her to move to the U.S. to live with me, and passport photos, etc. As well, I had to book her medical exam to be done in Canada.

After I had all the necessary documents, the consulate scheduled an interview for her. The interview was very simple and they basically only asked her why she hadn't come with me at the time I moved to the U.S. She told them she wanted to finish high school in Canada, and that was all they wanted to know from her.

She was approved the day of her interview (May 26, 2005) and moved to the U.S. on Sept. 5/05.

The K-2 Visa must be obtained within 1 year of the K-1 Visa. I made it by the deadline by just 2 weeks (my K-1 was obtained June 10/04 and her K-2 was obtained May 26/05).
