I’m new here! Before I continue I have to say thank you for all the information!

I was in America for 11 months and I never overstayed! was denied entry 2 times this 14 months ago! (was never illegal during my time in America) .

Me and my bf have filed for the fiancé visa! I’m planning on going to USA to visit my bf with my family for 2 weeks!

Would that be a problem?

Please a need help!

What was the reason you were denied twice if your didnt overstay? If your going to attempt to make the trip i would make sure you take plenty proof of any ties to your home country eg- mortage payments, letter from employer, bank statements but its down to the border patrol officer at the end of the day.

I got denied the first time because I had told that I had boyfriend!

U must get a visitors visa if your planning to go see your B/friend because of your denied entries but if you have already filed for K1 the chances might be very slim on getting a visitors visa, u can check this with the american embassy before u go on a long flight over there only to be denied again at POE

denied entry will not stop u from getting your K1 ...if and when u do go send your papers to USCIS make sure u kept your original documentation of denied entry and sent a photo copy of it to USCIS along with your K1 paperwork because the info about your denied entries will be on the System and i bet everytime u enter US they pull u up for questioning ... i know i been through a denied entry ( didnt show strong ties to UK was the reason) and beleive me it gets so tiresome having to answer the same questions so i know the process at POE, even when i got a B1 visa i was still pulled up and questioned.... but as long as u have a travel visa things should be fine ...If they issue u one.

While you were in the US for 11 months, did you renew the visa that allowed you entry? If not, you indeed overstayed. Otherwise it is strange they would deny you entry later; but since they did, there is that question-- did they give you reasons for the denial?

I had the B1/B2 visa! What they told me last time I tried to go back was that I had to stay in my country longer than 12 months because I was in USA for 11 months!

Like said before your chances on getting the visitors visa are slim to none because you must prove you will not immigrate to the USA! Also If somehoe you got it when you got to your port of entry and if the Ucis officials there nkow you have a k1 visa petition pending they might not even let you enter the country when you got there! I would also not want ot risk at taking the chance of it messing up the k1 fiancee visa! I asked my legal friends about this a coulpe months back because I wanted my fiancee to do the same thing and they said it would be ill-advised!

You could always get your fiance to visit you in your home country, or do what some do, meet in Canada, thats what me and my fiance did

Great point! I was in my fiancees country 3 of the last 6 months))) :thumbs: It is alot easier to do it this way!!

I had the B1/B2 visa! What they told me last time I tried to go back was that I had to stay in my country longer than 12 months because I was in USA for 11 months!

The right question is, did you get an extension to stay passed the date stamped on the I-94? For what I know (and have experienced every time I've traveled to the U.S.) the longest you are allowed to stay when using a B1/B2 visa is 6 months. If you stayed 11 months you had to apply for an extension (permission to stay longer than 6 months). If not you did not apply for an extension, you overstayed.

There is a difference between the validity of the I-94 and the validity of the B1/B2 Visa. The I-94 is the form that establishes the basis of your admission into the U.S. and says how long you can stay in the U.S. (it is stamped by the POE officer after you are admitted into the U.S.) Visa is the document that allows to travel to the U.S. and can be valid up to 10 years. The validity of the I-94 is different that the validity of the Visa itself. You can't stay in the U.S. after the date stamped on the I-94, eventhough your visa is or might be still valid. For example, my tourist visa is good for 10 years that does not mean I can stay 10 years with that visa in the U.S. :no:

POE officers would question your intent if they notice you've spent more time in the U.S. than in your home country for the last year. When did you go back home? If it has not been a year since you went back, I suggest you don't make this trip yet. And also, I suggest you find out if you did overstay, if you did not file for an extension most likely you did overstay.

We asked our attorny the question about visits while on a K1 - she was pretty firm I would get turned back at the POE - so we decided to save the money for when I am approved, and just tough it out :)

For some cases that might be true, but isn't always like that. Many have traveled under the VWP while the K-1 is processing and some others like me, have traveled with B1/B2 visas with no problem at the POE.
