I believe it's relevant in this case b/c the petitioner couldn't accompany the fiance to the interview in Canada. I'm under the impression that Canada won't let you in if you have a DUI or drug charges. He can still petition, but he can't be at the interview.

Yes, that's correct. Canada won't let you if you have DUI or drug convictions. But I took it to mean that her boyfriend wasn't allowed to move to Canada so that's why she was moving to the US. Sounds like quite a couple.

You can file for a waiver & pay a fine. But the waiver itself takes months to process and I'm assuming that if they didn't know the basics of immigrating, then they wouldn't be informed about the specifics of getting into Canada with a DUI on your record.

Although, y'know what? I had to inform myself about the US immigration process. We talked for months about getting engaged/married and no one ever said "oh hay, btw, you're going to have to go through this expensive and long process..." The boy & his family were under the impression that it would be as easy as getting his F-1 had been. People on my side were shocked that he needed ANYTHING to immigrate to America. The whole "isn't Canada part of the US anyway?" mind-set is very common and I can see how someone might fly under the radar if they didn't take the initiative to research it themselves. Even the family friend whose wife emigrated from Bosnia to the US on K-1 seemed surprised that a CANADIAN would need to go through the process as well.

So yeah, it happens. Still, that's a pretty funny situation.

when I went for my UK visa (Ancestry), I had to gather various documents (including my grandfather's birth certificate from Scotland, which took a little procuring... it had a warning on the back that 'giving of false information is punishable by transportation' ) and then drive down to the UK consulate in Canberra (I'm from Sydney) and then sit there for half the day waiting for my number, which had been issued at the door - no appointment necessary - to be called... I went to the window, presented all my documentation, was told to go and wait elsewhere (there being nowhere else, I sat in a service station cafe for a couple of hours) and then returned to pick up my passport, with visa now attached

of course, I'd done my research beforehand, and if it had been a longer process I would have been prepared for it, but I'm sure I'm not the only one who was mildly amazed at the length of time, comparatively, it took to get the K-1
