AOS FILERS - April 2008

Quick update of my horrible USCIS adventure.........

For those that haven't read my previous posts....AOS, AP and EAD filed for in April.

USCIS receive date = 16th April 2008

USCIS notice date = 21st April 2008

Biometrics = 8th May 2008

So my 90 days from notice date was up 2 days ago. I went for an Infopass this morning hoping they would help (im desperate for my EAD, im not that bothered about the rest right now)

I explain my EAD was filed for over 90 days ago, he brings up my info on screen and says i filed on 16th April (the receive date!!!), all he can do is send an email to them to expedite the process - this can take another 30 days he says :( I ask if it can go faster - no. I explain to him there are many cases that applied after me and receive their EAD's last month, I ask how this is possible if they process in order they receive. He tells me each case is different and mine is only 1 week late. I tell him its one week late if it comes today, if it takes another 30 days they it will be 5 weeks late! He did not understand this at all, he could hardly speak English and our conversation went on for ages. Eventually I gave up and asked if he could send the email straight away as I have a job offer waiting and it is very important that I have my EAD. DON'T WASTE TIME WITH INFOPASS.

I get home and decide to phone USCIS help line, unfortunately their systems are down and they say to call back in a couple of hours! So I ask a couple of general questions.......

Q1) When your systems come back up, what can you do for my case as it is outside of normal processing times?

A1) We can get someone to pull the case and look at it to see what is happening with it.

Q2) Will they be able to process it then as I am desperate for this EAD and have waited longer than 90 days?

A2) They will be able to find out what needs doing to complete it.

Q3) How long does this take?

A3) 45 days!!!!!!!!!!!!!!!!!!!!!!!!! (WHAT?! the last bloke said 30 days - I didnt say that on the phone)

Q4) 45 days....Really. Is that an expedited process? Its just I've waited more than 90 days and I was hoping it may be able to be done quicker as its a desperate situation now.

A5) Once your case has been pending for more than 75 days we can expedite it which takes up to 45 extra days.

WHAT..........75 DAYS...........WHAT!!!!!!!!!

Thats right she said after 75 days!!! NOT 90 days, but 75. Where did this random number come from??? LMAO unbelievable.

I did note though that 75 + 45 = 90 + 30, so maybe 120 days is the actual date u can expect to receive your EAD.

I will phone back in a couple of hours like suggested and hope their systems are up. Maybe I will get a decent answer one day.

This is really frustrating.... Where is your local office? I am wondering if I should even set up Infopass or just give them a phonecall....

My Local Office is Santa Ana. I think I am just going to keep calling once or twice a day, just to keep hot on their heels.

I feel for you. It difficult to understand why some people get approved so fast and others don't. If indeed they process on a first come basis, there should not such a big incongruence between people who get approved immediatly and people who are waiting months....years.

Systems have been down all day so had no luck over the phone, going to try again tomorrow. :(

The last person I spoke to at USCIS seemed to think that I could apply for an expedited process after 31 days of application! I asked her if she was sure she meant 31 days and not 90 days, she read her notes (lol) and said 'I mean 31 days after the processing time'. That means you have to wait 121 days from date of application before you can apply for expedited processing. I told her on the website that if an EAD application has been over 90 days I would need to call in, I told her I think that you only wait 120 days if its a different type of application - as per what the website says. It went silent for ages (she was reading her notes) then she said 'oh'. I said i would call back tomoz when the system was up and running! lol

OH goodness gracious! It's so frustrating putting your life on hold (without any income coming in at that!).

I'm slowly feeling this is going to be my situation. It's been two months and the third month is coming up. I haven't had a single sign of life on my case at all. I'll schedule an Infopass in New York, just hopefully they have some kind of solution.

I've got a job on hold but there's only so long they can hold that for and I can't fault them if they decide to look elsewhere. Makes you want to pull your hair out geez :lol:
