Whats next after getting EAC?

Hi All,

This is my first time on any forum on the internet period.

Here is my case and sorry if this case has been discussed somewhere else before but I could find anything.

I am a foreigner married to my US Citizen wife :)

All the applications for adjustment of status went well I think. At the end of 2007 I received my Employment Authorization Card (EAC) and I also found employment.

I'm curious to know when the GC will arrive or how long it will take since we haven't heard anything from USCIS. We did go to the interview in 2007. Is it simply a matter of waiting or when should I enquire about the GC? We have been married for a year now!

Since we did everything ourself without lawyers. Have we missed a step?

Cheers

James

Since you already have your EAD, it sounds like you are on the right track. As long as you don't get an RFE, it's all about waiting and being patient.

You can register online for email updates regarding the status of your cases. Also, check the processing times. Once you are a certain amount (is it 30 days?) out of the posted times you can request an inquiry and see what is going on or in worse cases get help from your Congressman.

I know you are new to VJ, but it would be very helpful to fill out your timeline, that way, everyone will be able to help you more accurately when it comes to questions about timing.

Thank you :) Vielen Dank!

OK Nane, Since I am new some of the acronymns I don't know. Please enlighten me!

RFE =

How do I know my case number? All the corrospondence that we have received have a code starting with MSC. Going online and entering that receipt number only gives the status of that particular receipt but not the overall status.

I will enter my VJ information asap but I'm no longer sure about the dates as some documents where retained at the USCIS office!

I have no idea how many days you have to wait for the GC? What if for some reason or the other (and we had it happen already with my SSC card) the GC got lost in the mail? How can inquire if the GC has been already processed?

From what date is the 1st (2 year) GC valid? From when the EAD expires or is that irelevant?

I know its lost of questions but please help :)

Thanks

Hi James,

RFE= Request For Evidence

Your case number your receipt number

Also, in regards to your question about your "overall case". Every form Serves a certain purpose. but the I-485 receipt number is what will let you know when you get you your green card, it will say "card production ordered". Then you will soon receive it in the mail

Employment authorization card. The EAD expires (i believe) after 2 years.

A RFE is a Request for Evidence in case they need more documents from you. They can come anytime, but if you filed everything correctly, you are most likely to not recieving one.

The MSC number is your case number to track the status. If you register on the USCIS website, you can sign up for automatic email updates, if something changes=if your case is making any progress. For example, it will inform you about transfers or approval before you recieve the paper in the mail.

What overall status are you talking about? You can only check EAD, AOS, AP individually. You file together, but at the end they are separate things.

The time it will take to process your application varies a great deal from case to case. That depends on when you file, where your local office is, how many people have filed at the same time.

The fee increase last year made a lot of people file right before that and USCIS is still struggeling with those mass applications.

When you are getting approved, you can check that online and will get an approval notice in the mail. You may also get an update saying "card production ordered" and after that it usually only takes a few days to a couple weeks for the gc toarrive. If you don't get it, you can inform USCIS and there are certain procedures to get you a new card.

Make sure your mailbox is clearly marked and maybe add your name on the inside of the box for the mailman.

The greencard has an expiration date on it, it is valid from the day of approval for two years.

It has nothing to do with when your EAD expires, it's two totally different things!

Your EAD is valid for one year and you can apply for anew one before it expires.

If you go to the timelines section, just fill out the dates you still know, like when you filed, what you filed for, when you had your biometrics taken,...

Thanks!!
