DO YOU HAVE TO WAIT FOR YOUR CITIZANSHIP BEFORE FILING FOR A BROTHER TO COME OR CAN YOU FILE WHEN U HAVE YOUR GREEN CARD AS IT TAKES SO LONG TO BRING SOMEONE HERE AND THE PERSON WILL BE A CITIZAN BY THE TIME THE BROTHER IS APPROVED.

I believe a Permanent Resident can petition for a sibling, but it can take 10 years or longer - most advice waiting until the PR gets citizenship as it is, in the end, much quicker. :thumbs:

No an LPR can not File for a Sibling. You need to be a USC.

Who are the relatives that I may petition for?

Any permanent resident can file a petition for the following

relatives:

• Husband/wife; and

• Unmarried child(ren), regardless of age.

In your petition, you will have to prove your relationship to the

person for whom you are filing.

It may take OVER 10 Years they are just processing from July of 97 depending on which country the brother is from

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:

A. Your husband or wife;

B. Your unmarried child under age 21;

C. Your unmarried son or daughter age 21 or older;

D. Your married son or daughter of any age;

E. Your brother(s) or sister(s) (you must be age 21 or older);

F. Your mother or father (you must be age 21 or older).

2. If you are a lawful permanent resident of United States, you may file this form for:

A. Your husband or wife;

B. Your unmarried child under age 21;

C. Your unmarried son or daughter age 21 or older.

You have to be a Citizen first. LPRs can only file for people in list #2
