My fiancée is concerned that once she arrives in the US on her K1 visa that she won't be able to return home to visit her family for more than two years. She got this information from a friend of hers who is currently in the US on a K1 and recommended that we file for a K3 if she wants to return home sooner.

I did some research here on VJ and just want to confirm my own conclusions. If we file for a K1, then my fiancée can return home once her I-485, AOS, is approved. According to the USCIS timetable that takes about 7 months to process(CVS). The 2 year period that her friend claims appears to be a worse case scenario. If my fiancée wishes to return home sooner than that, or just to be on the safe side, we have the option of filing for an I-131, Advance Parole, which appears to take about 6 months to process(CVS).

Am I missing anything here? I just want to make sure I got all the facts straight before I explain them to my fiancée, so there wont be any confusion further down the road.

Once you get married, send out the papers for the AOS and along with that the AP (permission to travel before residency is granted). That can take +- 3 months to be approved (I think 6 months is the worse case scenario).

My husband's AOS took a long time and that was still 10 months after he arrived in the country...

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

all the time lines i've seen for AP have been 2-3months MAX.. that being said if your case has some issues behind it, it could take longer.. and once you get it, you can leave and come back etc etc.

Your fiancee's friend is mistaken and your conclusions are correct. Your fiancee will be able to travel outside the US after she receives her green card which will probably be 3-6 months after filing the I-485.

You apply for AP (I-131) at the same time you apply for AOS (I-485) AP takes about 90 days to get, the AP doc will allow travel abroad while waiting for AOS.

Her friend is wrong, her friend mus not be aware of Advance Parole (I-131), and thinking of the worse case AOS timing of taking up to 2 years to get a green-card.

FAQ: 6.7)...Can my spouse leave the United States, and then re-enter, before receiving the Green Card (conditional permanent residency)?

THREE TO SIX MONTHS? Now that is wishful thinking...

Correct!, AOS can take as little as 4 months if you get lucky and get approved without interview, but it can take much longer (Months to YEARS) if it gets handled by a slow field office for an interview, or gets hung up by a lengthy name check.
