So I'm in a bit of a pickle. I live overseas with my fiancee, in South Korea. I've been here for about 2 years, teaching English. Now, we're engaged and waiting for a K1 Visa, but if we have to return to the states in july/aug for my upcoming teaching job that i'm looking for at the moment, the visa may not be ready. Does anyone have any information about taking your fiancee to America on a tourist and notifying the embassy so you can continue the process from there? I'm thinking like a 30-90 day tourist visa or something, and bringing all the needed paperwork etc with us when we go. I don't want to part ways, and because of the way semesters start in the states, i kind of need to be back for july/august. I've also given notice to my korean job, which ends in july. Really dunno what to do right about now.

Sent 129F packet in via express during the first week of march

received date march 6th, 06

NO1 date march 7th, 06

waiting on NO2...

Im afraid you have to hope and pray that you can get your visa in time. US Immigration will not allow your fiance to enter on a tourist visa when you have plans to marry.

You could investigate to see if DCF is possible in Korea. That is faster but not available in all countries.

I guess this is similar to the topic "marriage on a tourist visa, marriage". Hrm. still, wonder if there's any contrary advice. Seems like I might be stuck in South Korea indefinitely, until I get this visa passed through. Which means it'll probably get pushed back to december before I can return to the states for the spring semester of teaching.

Although it is doubtful that your fiance would be given a tourist visa with a Fiance Visa application pending, as long as she can prove strong ties to her country (such as mortgage/lease documents, pay stubs, letter from her employer/school, etc.) indicating that she intends to return to finish the processing of the K-1 Visa, she may be given one.

If not, you could always return to the US yourself, start your teaching job, and she could follow after the processing of the K-1 Visa is completed.

Good luck with whichever option you choose.

get married there, go to the US Consulate and file directly with them for resident visa. Since you are legally a resident there, you should be able to do this. Check out your options with the US Consulate there first before you do anything, and read the website to see if you qualify to file directly with them.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Hi there, I am in a similar situation as I am about to start the fiance visa application process, but we are hoping my fiance can come to the US at some point and meet my family in the US before (she is Vietnamese, but currently going to school in the UK).

I sent a question to the London Embassy about two weeks ago and their response made me hopeful which was:

'Whilst your fiancee is applying for a K-1 visa she may make a temporary non-working visit to the U.S. on a B-2 (holiday) visa. She should carry with her evidence that she intends to depart the U.S. at the end of her stay and return to her residence in the U.K. This is generally established by evidence of family, professional, property, employment or other ties and commitments to some country other than the United States sufficient to cause the applicant to return there at the conclusion of his/her stay. If U.S. immigration are not convinced that your fiancee is a bona fide visitor for pleasure you can be denied entry.'

Perhaps they are like the USCIS and each person gives a different answer, but we are hoping she will be able to get a tourist visa.

To be on the safe side, do you all think it would be worthwhile to hold off on submitting the fiance visa for a couple weeks until she applies for her tourist visa (appointment scheduled in about 3 weeks)?

Your fiance will have to interview for the visa in her home country, there is no way to continue the process from within the US. Having her come here on a tourist visa with the intent to adjust is illegal, as that is immigrant intent, and will get you some serious consequences down the line.
