Divorce Judgment

Well I am expecting we will receive a RFE. I sent in a copy of my fiance's Divorce Judgment with the petition. In today's mail, I receive an original Certificate of Divorce from his fricken attorney. Now I am wondering if this is what I should have sent. Plus, she only sent me a fax of the Divorce Judgment and never sent me the original certified copy.

I am about ready to cry and scream at the same time.

I'm not sure about the difference in the forms.... could be a judgement is not the same as the actual decree.

I am not sure if you can send anything in until you get an RFE.

Maybe you won't!

I am not surprised because all this attorney has done for us is cause us grief. I would like to call her and give her a piece of my mind.

Copies are acceptable when submitting the I-129F. Originals (or certified copies) must be available upon request at the interview.

My experience is the same as Trey's. I just sent a photocopy of my divorce decree (as required) with the initial I-129F application. No originals were requested or required. My application was subsequently approved for forwarding to the NVC. I'd just wait and see what, if any, further documentation is required before being convinced your application is refused.

I am just concerned because I have two different documents. The attorney told us the divorce was final March 17, 2006. The date stamp is March 20, 2006 on the Divorce Judgment. This is the date I used on the petition paperwork. However, in Canada they have a 30-day 'cooling off' period. Now I am wondering if the divorce wasn't actually final until April 20th, and we signed all the papers April 18th. I have so many concerns now running through my head.

Don't worry and panic, even if you receive the RFE.

I got one and mine has delayed the process by 2 weeks only.

Well I think I am really screwed because of being misinformed by his divorce attorney. As I stated before, she stated the divorce was final March 17th but the Divorce Judgment says March 20th. The new paper that I received today states the following:

'This is to certify that the marriage of blah blah blah that was solemnized on the 15th day September 2001, was dissolved by a judgment that became effective on the 19th day of April, 2006. Dated at Calgary, in the Province of Alberta, this 20th day of April 2006.'

I thought the Divorce Judgment that we received before was the final thing because it had judge's signature and a court stamp. Now it looks like we are totally screwed because we dated everything April 18th and I put the date of termination of the divorce as March 20th.

Why me?

Awww Jen. Well ya never know. They may look at it and think its the right paper, too. And if its not, then you send in what you got today for the RFE. It shouldn't be much more than a few weeks delay.

Hi,

You're fine with the copy for the initial paperwork to the USCIS. You will however, need the certified copy for the interview.

I sent a copy when I filed for our I-130, and got my hands on the certified one this week. My attorney did not send it with the judgement either. When I called my attorney to request it, his paralegal made it seem as if I were asking for her for the holy grail...Given that it took over 1 year for them to take care of an uncontested divorce, I decided just to go to the courthouse myself !

It took 5 mins and the cost was .50/per page.

All you need to do is go to the city/county that the divorce was filed in, show I.D. and you're good to go...

I missed your post re:wrong information...

My husband messed up his mum's birthday year on his G-325's...as long as they have supporting paperwork, they should be smart enough to figure it's a simple human error.

Worst case, they send you the paperwork to correct, which you can turn out back to them the same day or the day after and you'll be back on track.

My idea,you should wait the immigration request the addtional evidence.

If you wait you maybe you don't need to send it though.
