:(:crying::cry: Well friends, It looks like we will have to cancel the visa process for now. Thanks so much to everyone for all the helpful information. We have found out that the marraige was registered with NSO. We are stopping the process until we get the anullment. We came so close to the interview. The interview was scheduled for April 4th 2008. this is such a heartbreaker. Vikki could have been here by the middle of April. Now we have no idea when she will be here. I dont make a lot of money so I wont be able to go back and visit anytime soon. Has anybody had to do this?. Since we voluntarily withdrawing from the process, will this create a problem for us when we re file? I plan on telling them that we have to take care of some loose ends and also I am working on bringing my wages up to be able to stand on my wages alone without a co sponsor. Let me know what you think.

You are correct, all you have to tell them is that you need to handle some problems and need to withdraw the petition.

Since it is at the consulate, you will need to contact DOS Visa services to do this, they may instruct you to send the request in writing.

Sorry to hear this..wish you good luck!

Don't want to kick you while your down but the annulment process is long and expensive. If you have questions drop me a pm. I have a good friend that went through this prior to his wedding in the Philippines. The saving grace; he is retired and living in the Philippines so he was with his girlfriend during the process. He has recently filed for a K-3 and plans to return to the US next month to set up house while he waits out the K-3 process.

Annulments inthe Philippines can be done in 6-8 months and less than 2K. Outer islands are a bit cheaper than Manila.

Don't try and hide the first marriage as it will show up if USEM does a CENMAR or CENOMAR check. May as well tell them the truth when withdraw.

Shouldn't be any problem with next petition.

Be sure and notify your service center also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would be very careful about giving any reason for the withdrawal that would leave open the possibility that there are problems in the relationship. "take care of some loose ends" could do that. "We've decided to delay immigration until later and may marry first." would probably be better. No reason is need be given.

You will have to write a formal, original letter to NVC, USCIS and the Embassy. Simply stating your intent to withdraw. Whether you go into precise detail is up to you. You need to sign it and make copies before sending them out. Be sure to include info like beneficiary's name, birthdate, and case number. It can take up to a few months for the petition to be officially canceled. The embassy will have to send it back to NVC to be terminated, then NVC sends it back to VSC, where it will sit in a crate collecting dust until the end of time. Well, this was the info given to me when an old, forgotten petition needed to be terminated. Some people.....ahem..(ok, so it was me)..think that the petition simply dies after one year of inactivity. That's what the instructions would have you believe. Not the case. I was shocked to learn that my old petition was still breathing after a few years. Got this info just as i was ready to send off Sasha's petition. I panicked, called NVC. They gave me the instructions I stated earlier. cool. No problem. I sent the letters, waited a week, then sent off the new petition. I assumed that it should be very easy to terminate a petition. I mean, seconds really. You would think. the weeks passed by and after a couple of months we started to get very nervous because the status of that old petition never changed. Made several phone calls, all ending in that scripted disappointment and uncertainty. Checked online. No change. We became extremely nervous that our new petition would be handled while the old one was still active. That would be certain denial and a very large hurdle to overcome. Finally got elected officials involved after nearly 4 months, with a mass produced email. And amazingly, within a few days I received the official notice from USCIS, and a letter from the director. It was finally terminated. one call from a politician seemed to do the trick. Then days after that, we got an approval for our new petition. Connection? Who knows. But that is what I learned about terminating a petition.

Just to note, the first petition was a K-3. And it was abandoned while at NVC and the marriage ended in a divorce. Years later it was still alive. I would recommend writing some letters ASAP. And calling DOS. You can use the NVC phone number and they will give you the addresses to use. If more than a few weeks pass and hear nothing, I'd strongly suggest getting your elected state officials involved. I don't really know how to handle your other questions, but terminating a petition I know. Good luck to you.

I'm so sorry to hear about this. If there is indeed a less than 2k annulment here in the Philippines, I would say grab it coz by what others have shared, they spent 150,000 - 200,000 pesos (3,750-5,000USD) for their annulments here in the Phillipines and some even more.

Don't ever lose hope, this too shall pass.... I will be keeping you guys in my prayers.

It's good enough that you've learned about that earlier and there's still time to cancel the petition rather than learned it later.dont worry,you'll be fine,dont be in a hurry,in God's time you'll be together forever without anymore hassles like that.that only means that you will still have lots of time to know each other well and make your love for one another grow stronger than ever.Hang in there.

Wow my heart goes out to you guy , me and my fiance are just heartbroken here , my fiance has known this situation before and here is the advice she has to give:

The pinay fiancee should seek a CENOMAR and birth certificate first, thats where she will know her status at National Statictics Office.

If the marriage was really on records

Thats where they should start.

If the marraige was really on NSO. They will have to file an annullment that will be based as "pressumed death" that is if they are not living together fo the last 10 years

Hire a lawayer, that is expert on family code

There are pro-bono lawyers in phils,

PAO-public attorney's office

At PAO, they can seek legal advise for this matter

for free

We have to make use of the taxes we paid for those lawyers just sitting there all day... lol...

Also keep the faith , love will prevail
