My greencard has been pending since December 2006. I am way out of the processing times but nothing is happening with my case. I wouldn't mind that at all and just wait it out and hopefully get my unconditional greencard after being married for two years in August, but my husband is in the military and we are PCSing to Germany in June.

It is not a deployment, even though I know he will deploy sooner than later once he is there.

My problem and question is:

Can I get my application expedited or how would they handle my case if I have to leave the US? My AP expires in August?

Can anybody tell me, how to apply for expedition of my case? Is there a form somewhere or do I have to make an Infopass appointment?

If someone could give me some goood and helpful information about this, I would really appreciate that a lot.

(PS: I just found out that I am pregnant, and that really doesn't help my stresslevel..lol)

You can make an infopass appointment to try to have your greencard expedited.

definately get an infopass! hopefully they can help you!

the only thing i know for sure is that youre time in germany will be considered living in the states cause you will be there on your husbands orderes!

its ridiculous how long youve already been waiting for your card! :blink: i got approved within 3 months!! maybe they lost your whole application? i just hope thats not the case!

id recommend to post that in the german thread too since there are a lot of girls with military spouses!

Right, as long as you or your family was assigned abroad as part of a government or military position, it will not count against the residency requirement of your greencard.

Make an infopass appointment and explain this to the IO. They can direct you on what to do.

as long as you are in Germany on military orders you will be considered as if you are still in the US.

Get an appointment to talk to some one. It seems weird that you are waiting for so long!

My husband's case had been pending since January 2007. He finally received his green card yesterday in the mail. Our case was also way out of processing times and we decided to contact our local district congressman to seek his help. There are people that went and got an appointment with infopass which helped, and there were some on visajourney that spoke to their congressman. I think either or would be fine, but try going in the order of 1. infopass and 2. congressman. That way you'll be able to show the congressman that you did everything in your power, but ended up with no solution. I'm sorry that you have to go through this while you're pregnant. It's stressful enough as it is when you're pregnant, but waiting around for a card that you're not sure when will arrive drives a person mad. I know this because I was pregnant while waiting around for my husband's green card to come around. I gave birth in December 2007 and his green card finally arrived!

Good luck! Hopefully you'll get some sort of response soon. Check online for your status on the case.

Timeline:

March 22, 2005 - Sent in Petition for Fiance Visa (i-129f)

March 29, 2005 - Had to resend petition (insufficient stamps)

April 8, 2005 - Attempt #3 sending Petition (is there an unknown conspiracy against me? i put $3 worth of stamps and it's returned to me)

April 21, 2005 - Received Receipt for k-1 visa (NOA #1) receipt was dated 4/11/2005

May 2, 2005 - Received NOA #2 (finally these people are getting their act together)

May 12, 2005 - Found out that NVC sent in my petition and all that good stuff to Korea on May 4, 2005 (i can't express into words how happy i am)

June 16, 2005 - Looked up our case number online to check our interview date..and our number was there!!!

Our case interview will be on July 14th 2005!!!

July 14, 2005 - Interview. and it was a....SUCCESS!!!!!

July 21, 2005 - My fiance and I are in the US of A FINALLY!! We have 90 days to get married.

September 21, 2005 - Coincidentally, we got married exactly 2 months after.

September 23, 2005 - Starting the Adjustment of Status and EAD process.

Ok, this is getting more and more frusterating: I called the customer service line (I know, I know...) and talked to a pretty helpful young man. He put in a service inquiry and 5 minutes later I got to talk with an Immigration Officer. (A real one)

After some confusion with my A# (I have two different ones obviously) he got my case on his screen and ooops, it is not pending at my local oofice, it is still pending at California Service Center. For over a year now.

Well, I had contacted my Congressman about 5 weeks ago and haven't heard anything and now I know the reason: The inquiry got submitted to the system just yesterday (huh, they work sundays??) and will take about 30-45 days until I will hear anything.

Until then, there is nothin I can do.

As soon as we have my husbands orders, we can either make an infopass appointment or write to the National Benefits Center and explain the Situation.

I am reall mad about this getting dragged along for forever. If we stayed here, I'd gladly wait a little longer and get my permanent resident card and not lift conditions, but I don't feel like flying back here just for an interview. Plus, by then I'll be too far in my pregnancy to be able to fly.

AAAhhhh...... :help:
