Hmm posted this yesterday and it disappeared...so here goes again.

When do people seem to get their RFE's (if at all)? Is it usually very soon after the NOA1 (indicating that someone actually went through the file after picking it up and putting it on their desk) or was it a while after the NOA1 (indicating that the file gets picked up and then put on their desk, to be reviewed as they get to it)? The reason I ask is they received my K1 package this week and I have a chance in 21 days or so to visit my fiancee for 4-5 weeks and I'd hate to be over there if I were to get an RFE here.

The NOA1 only indicates that the petition was received. It does not mean that it is on a desk for review.

It is very common to get a touch a couple weeks after reciept but all that seems to mean is you have been consigned to a box that is heading for a shelf for the next 4 months. It is after it has been properly aged on the shelf that they pull them out and seemingly do everything in a matter of days. I wish they would realize that all this space to store boxes is costing them money. :innocent:

If one were to get an RFE, it would be at the stage where the petition is being reviewed for approval; meaning it takes as long to get approved as it would to get an RFE (once the adjudicator reviews your petition, he/she either approves it or will ask for RFE)... :thumbs:

I filed in Vermont just like you will.

I got my NOA1 approval on October 22 and received a RFE notice e mail on Feb 5. It took another four days to receive the hard copy in the mail (Feb 9). I had 60 days to respond. It seems like the processing times are moving a little faster now but you never know. I would send in the K1 ASAP and you will most likely be OK. If you send in your K1 this week you most likely have a NOA1 before you leave.

I would make sure to sign up for automatic e mail notification from The Department of Home Land Security once I get my NOA1 approval. That way you will receive an e mail notification if they are sending you a RFE. That way you will know while you are on your trip. If you are having someone getting your mail while you are away you can tell them to be looking for it. I have e-fax. If you have such a service they could then fax you the notice and you could get it via an e-mail attachement.

This would be helpful especially if they have asked you for something about your fiance since you will be there with her. For example I have read rare cases where they have asked for a ladies birth certificate.

I will make sure I sign up for email notification, thanks for the advice.

Things must be moving much faster now...I sent in my K1 application, they received it Feb. 19, and I got my NOA1 3 days later and it was dated for the same day they received the application, Feb. 19. Wow...I hope the rest of the process shows a similar decrease in processing times.
