Hi,i gathered from your post that she admitted that she got married in 1997,so she knew by heart that she's still married and is not capable of applying for a k-1 visa,did you ask her if she signed for a marriage certificate when they got married and if she keeps a copy of it?if she's seen a copy and knew that it has been registered,there's no use of getting a CENOMAR coz it will just show her record that she's been married and still very much married.Now if she'd never gotten any copy nor have seen their MC she should apply for a CENOMAR or at least get a copy of their MC,she should first try getting a copy from their local civil registrar where they got married,because sometimes,local civil registry didnt get a chance to forward it to NSO the reason why they have no copy.

You may want to cancel first your K-1 application and sort this out first to avoid delays or even a possible denial for not telling the truth.

About her BC, if the US embassy will verify it,and if there were 2 different names listed on different BCs, it's possible that they will get both copies if the names of parents and her birth date are identical.

I wish you goodluck and may you be able to find a solution to your problem.

I think the OP did say that the beneficiary is not really sure if it was registered or not.

I had a wedding 8 years ago and I did sign a marriage contract during the ceremony... if i did not try getting a copy of the contract for adjustment of my kid's status (supposedly from illegitimate to legitimated by virtue of parents' marriage) 2 weeks after, I wouldn't have known early on that my wedding was not yet registered at that time and that the priest who officiated had not received his renewed license the time and day of the wedding.

another case is my friend's parents, after 30years somebody is claiming that they were the legal family since the marriage between my friend's parents 30years ago was not legitimate... all those 30years there was never a question of the legitimacy of the wedding, until recently.

my point is, signing a contract and holding a copy of it and thinking that it was registered is not enough to verify if it was legitimate or not... sad to say there are a lot of couple here who in good faith, thought that they were legally married to their spouses only to find out after several decades that the marriage was not legal after all due to some circumstances.

as of going to the local civil registry, the certificate printed on NSO paper is the only accepted document now, even in local colleges and universities and most especially with USEM. getting a copy from the local civil registrar doubles the amount (pay for the local registrars copy then, pay for the certification @ NSO-- learned that mistake when i first requested birth certificate for our school--- and sadly, it was still rejected coz they wanted a BC printed on NSO paper-- papers from local civil registry with NSO certified stamp was not good enough because that is easier to fake)... and USEM will only verify documents directly with NSO not with local registrars. Getting CENOMAR @ NSO is just 180 pesos, birth certificate is 125pesos, a small price to pay for your peace of mind, why go through the hassle of going to the local civil registrars...

as for the 2 birth certificates, she needs to get court order that the person on the first bc and the 2nd bc is one and the same (sadly this process takes months), that is only if both BC are registered with NSO or if she have legal documents under both names... she have the responsibility to have this sorted before her interview and not just go and let the USEM sort this out themselves.. that is if she wants approval and not AP.

BTW, i did not list the biological father of my kids as ex husband or spouse on the USCIS forms nor did i list any previous wedding date or annulment date since we have no record of any marriage at all and the court said there was nothing to annul because there was no record at all and it was 8years ago, way way pass the time limit allowed for any solemnizing officer to register any marriage. So, if the OP's fiancee don't have record of that marriage she contacted 10years ago, then their K1 papers are still good to go... i would say verify the facts of that supposed marriage first and clear up the problem with 2 BCs before deciding what to do with your K1 application.

When I said to go and check with the local civil registry is for her to find out if there is really a registered copy of their MC to avoid hassles in the end.It happened to my former officemate before,she knew that they got married but didnt get a copy of their MC at NSO and her CENOMAR stated that she was single,that was 12yrs after their marriage.but the problem started when her ex husband made an appeal,with their MC in hand.it turned out that in local civil registy,it was registered,it was negligence on the part of local civil registry that they didnt able to forward it to NSO.your case maybe different from her case.yes,i knew how much it cost to get a copy at NSO,i was just saving them from any trouble just in case.

regarding the BC,they can easily fix it at their local civil registry,but the processing will take 5-6mos especially here in Manila.I know also that USEM only accepts MC,BC and other documents if it's being issued by NSO.also,i said USEM will find it out because like what they said,there's already a document verification being paid before the interview.

I was just trying to give the OP some possibilities.it's better to check from other government services where they think the MC passed thru rather than to be sorry afterwards.it was just an opinion.

Hello everyone, this is Vikki..think it's time for me to say my piece to clear things up and not leave all the pain to my beloved Phil........I was using my name vikki since I was a kid until I finished college and working...in short all my documents for over 40 years is named vikki. I first discovered I was not registered in our local civil registry since 1988 but didn't find the need to do the late registration.......life goes on for me without it. I was in my late 20's when I planned to get a passport and have to check for my BC again.....and since the lady registrar cannot find my Vikki in thier record book she really took time looking for it from my parents name and bingo...my parents registered a kid with my birthday/details..etc under another name. And that was it we just laugh it out knowing that for almost 30 years I am not vikki afterall, BUT, they had me baptized with it....what happened then was that the midwife who helped my mom registered me with a name that only she knew!

Comes another 3 years and I applied for a MC under civil wedding...the local civil registrar told me that I cannot use the name vikki because as far the Phil. statistics is concerned Vikki... doesn't exist..so that's it I was married with that strange name. The marriage barely lasted 6 months, he went to his provincial home and we never see each other again since then....that was exactly 10 years ago this year....we were separated before I even have the chance to change my civil status to Married....in between, I continue to use my Vikki in all transactions I made on legal documents afterall my GSIS, SSS and all other ID's were named as such...

2003 when I tried to apply for a passport again and as the law says I have to use my BC's name but when I go to our city NSO they give me a NEGATIVE CERTIFICATE OF BIRTH instead so I asked them if I can late register my Vikki now to straighten up my documents under one name.(.the freedom from the marriage under the other name only comes as a bonus, I dont have any thoughts of marrying again after what happened to the first ) the NSO verifier said if our local registry will agree then I can...and they did. So that year I was able to get a SECPA of the late registered BC, CENOMAR and a PASSPORT under Vikki so when I meet Phil I was considering myself free although the truth keeps haunting me for not telling him that part of my life.

The odd of it all, I already took SECPA from NSO MANILA twice in one year AND they give me two contrasting results, when I filed under Vikki they found me under the other name, the second time in a span of 3 days from the first I filed again under the other name and this time they give me Negative Certificate of Birth .......so I dont really believe they are that reliable....like the lady in our city's NSO said, 'just pray that the verifier who will handle your name is lazy enough to go over your file and that is by checking from mother's name or date of birth.

Well, for now I am waiting for the result of the the CENOMAR I asked from NSO Manila, the truth is it was registered here in our city's NSO, I'm just taking chances that they wont find it there or will get another contrasting result like my BCs.......but anyways I already talked to a lawyer, and I will be filing for Presumption of Death of husband (duh!). Just sad to note I just received my packet 4 yesterday and just stared at it knowing we will only cancel the schedule.....

well, i think regardless YOU knew you were married to this prior guy. You knew you didnt get it annulled. it was registered in your city, so it will probably be registered in NSO. You didnt tell your guy until WAY after the papers were filed and everything scheduled. You created this mess. You should have told your guy and straightened it out before he ever filed for you. You will now probably be in AR for an extended time and your guy is caught up in your mess now. what were you thinking hiding this part of your past???

I have to agree with Chris, all the waiting people do for these K visas and all the pain from being apart are very serious issues. When a couple rushes into this process it wastes valuable time for couples who are 100% bonafide for the process. Unfortunately, I was one of those clogging up the system as I needed an IMBRA waiver after rushing into the process then canceling after an interview date was set. I think Vikki should have told her fiance not just for the sake of the Visa in progress, but for the foundation of their relationship...truth. Good luck...maybe you'll get the proof of no marriage certificate and can carry on with the process dealing with the birth certificate issues at the interview. Its possible you may not have to withdraw the K1.

i agree with Chris as well, its ok to have some secrets about your past, small ones, but marriage and not annulled or divorsed is not something you want to hide until all of a sudden the papers are filed and approved.

Well people seems that this will be my last post. There are too many people in here that dont seem to have an ounce of compassion. I personally have a lot of respect for my Vikki for telling me at all. She could have let it go and tried to get it past the embassy. She did not do that. You guys did not see how she looked when she told me. She was in agony. Yes she could have told me sooner, but, she didn't and I forgive her totally. Sometimes when a person does not tell something at first it gets harder and harder to say it at all. She had the courage to tell me even though it was later. There are some people on this site that are very kind and I appreciate you. There are some that I feel if you cant give some encouragement or help in a subject you should keep quiet. I have read other peoples posts and some of the replies given and felt the same way about some of the response's given to them. Well I hope everyones journey goes well and you dont run into a problem that you have to ask for help. If you do I pray that you will only get the kind hearted people respoding instead of some trying to kick you when you are down. God Bless and thanks again to those who responded in a kind way with your helpful information :protest:

Hi! Yes we have some things to work out. Yes It is definatly for love. I have have promiseed Jesus I would love her like he said we should love our wife. He said to love her like Jesus loved the church. He forgave the church for all her wrong doing and even died on a cross for her. I truly love her and I know she loves me. Hey Phil - Its important to understand how HUGE this process is! I can respect you for not wanting to post anymore but on these forums you have to take the good advice with the constructive criticism. No one is doubting your undying love for Vikki nor the validity of her sincerity after telling you what at the time seemed like a minor issue. If I let the opinions of some of the posters on this forum affect the outcome of my actions I wouldnt be siting here with my husband and his greencard.

I admire you for your devotion to Vikki. As the old saying goes, "Take the Bitter with the Sweet". It all proves that your Love and Comitment to Vikki is Genuine and Unconditional... I can only wish you both success in getting this problem solved, so you both can be together. Stay focused because I know there has to be a way for you both to get through this. You don't have to leave, that's not the intention of these people's posts at all, no one is trying to run you out.

What they want you to do is look at this realistically.

Marriage is a serious commitment. It's about open communication and respect. Hiding something that important is a huge problem and I hope from now on that Vikki has learned to come to you when she has something that serious and important to talk about. Without communication and honesty, you have no where to go but down.

That being said, this is all in the past now, it's out in the open, she told you and all you can do now is mend those wounds and continue on.

I wish you all the best in your journey. Keep those lines of communication open, keep your love strong and respect one another.
