Questions on the I-864 are in the present tense. If you and your brother do not currently reside in the same domicile, he is a co-sponsor not a household member. He would need to qualify independantly of you rather than combining income. If that won't work, then you need a different sponsor or to move in together before signing and dating the affidavit.

Now when you say domicile does this mean we have to just have the same address? Because in my I-130 that i filled out i address what address we plan on living in the USA yes this is my address in the USA im not the owner or leaser but it is the address where i live in the USA and plan to live and as for my brother he also lives there... And also what forms are different between the co-sponser and household member because they just gave me and my wife forms I-864/I-864A... If he will become a co-sponser what does he have to send and fill out?

Also thank you for the reply.

Another question... Will my brother have to fill out a seperate I-864 as joint-sponser?

Yes, but first you must determine the answer to your first question, which is whether he qualifies as household member.

It sounds like perhaps he does but you mention only using the address on the form without saying whether you currently reside with your brother. If your current residence and his are the same, then the I-864a is ok.

Do you reside at the same address as your brother or not?

izreal,

It seems that you are a US Citizen currently living in Russia. Hence, your brother and you are not sharing the same address. In this case, your brother will file I-864 as a co-sponsor. However, if you are temporarily visiting russia and live at the same address as your brother, and have other documents/proof to back you up (e.g., your driving license, address with your bank, your paymment stubs (current or past) before you left for Russia), you may be able to have your brother use I-864A as household-sponsor.

I concur with pushbrk with everything he had to say.

Good Luck.

I live currently in Russia with my wife so no, but when i move back to the USA i have my address there where my brother currently lives... Sorry for not answering that...

You need your brother as your joint sponsor. He needs to fill out a separate I-864.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
