Timeline

I just got a letter from USCIS indicating

"It appears the primary sponsor or the petitioner did not meet the income requirement, therefore she may submit one of the following

JOINT SPONSOR I-864

copy of the most recent federal income tax return

evidence of employment

W-2 forms"

The thing is is that they sent a form requesting all this stuff before. I got a notice they received it. I subsequently got my EAD and Advance Parole. So I thought everything was fine! The evidence I sent in before indicated an income of approx $60,000.00, which as far as I can see, far exceeds the 125% of the poverty level for a family of 4, unless I misinterpreted the number.

Am I able to call someone to find out what's going on? We weren't expecting to have to get a joint sponsor. I'm pretty sure her parents would do it for us, but I'm not 100% sure. That would leave us in a bit of a bind.

Help!!!!!!!

March 4, 2005 - Met first time in Merrillville, IN (half way for both)

March 15, 2005

-paid a visit to Wisconsin-left March 31, 2005

May 2, 2005

-flew to visit Angela, left May 7

July 1, 2005

-flew to visit Angela on our first anniversary.

March 29, 2006

-mailed I-129F package to Nebraska

March 31, 2006

-confirmed package delivered by USPS

April 3, 2006

-NOA1

April 7, 2006

-NOA1 notice received in mail

June 6, 2006

-Transfer Notice to California.

July 3, 2006 - RFE received from California. Supplement to I-129F filled out and returned by July 6, 2006.

August 12, 2006 - NOA2

I would suggest looking at your paperwork to make sure that you didn't have a typo. Then resend the I-864 with the evidence and a letter explaining that you do meet the requirement.

During what time frame did she (She is the petitioner, right?) meet/exceed the income requirement? What documentation did you provide in support of the income declared?

Correct,

For our AOS, I provided:

  • I-864EZ
  • Three past years IRS transcripts (2006,2005,2004)
  • Letter from employer (On company letterhead explaining job, salary, full-time...)
  • 4 or 5 recent pay stubs.

Is now a US Citizen immigration completed Jan 12, 2012.

That is weird... $60 000 sounds way above the required income level! Try calling them, maybe... or perhaps contacting your congressman would be an option...

Did you get that stuff from Chicago or from your local office?

October 17, 2007 - K1 interview - approved

October 19, 2007 - K1 arrived in mail

October 21, 2007 - US entry

October 23, 2007 - Wedding day

November 27, 2007 - AOS, EAD, AP package sent

December 7, 2007 - Received all 3 NOA's for AOS, AP & EAD

December 10, 2007 - Received letter for biometrics appointment

January 2, 2008 - I-485 transferred to California

January 3, 2008 - Biometrics

January 16, 2008 - RFE for I-485

January 22, 2008 - RFE for I-485 arrived

January 23, 2008 - AP approved

January 25, 2008 - Case status finally updated: AP approved January 23!

January 31, 2008 - EAD card production ordered

February 2, 2008 - AP arrived in mail

February 5, 2008 - Sending a letter/RFE to CSC

February 5, 2008 - EAD card production ordered (again?!)

February 7, 2008 - RFE/letter arrived at CSC

February 7, 2008 - EAD approval sent

February 9, 2008 - EAD card received, dated January 23rd!

February 25, 2008 - CSC finally acknowledges receiving RFE

February 27, 2008 - I-485 APPROVED!

February 27, 2008 - Online case status: notice mailed welcoming new permanent resident.

March 3, 2008 - Received welcome letter

March 3, 2008 - I-485 approval letter sent

March 6, 2008 - Green card arrived in mail.

November 2009 - Removal of conditions...

Timeline

I called the USCIS to inquire as to what was going on. I explained that I had already received a request for evidence in October. I sent it off to Lee's Summit, MO as directed. In December they forwarded my case to California to speed up the processing. Then I received a new request for evidence in February. What I sent off originally was evidence of income and supporting income tax documentation. It showed that to date, my wife had made approx 40,000 in income. When I explained that to the person on the phone, she said that they was no evidence that they had sent me a letter in October?!? So now I have to re-submit everything with a letter explaining I had already sent it in and that a co-sponsor is not needed since she had made approx 56,000 last year. How the information I sent in got misplaced I'm not sure. I know they received it because my whole case was on hold pending receiving it. That included the EAD and AP, which I have subsequently received.

There....just had to get that off my chest....lol.

July 1, 2004 - Met online
