All-

Need some help. I was going to fill out the i-134 form on the website but then I noticed it expired in 2007. Is this still the valid one?

Which one is everyone using?

K1 Visa Timeline :

07-27-2007- Sent out I-129f

08-07-2007 : Received NOA1

12-23-2007 : NOA2 approved

12-27-2007 : NVC Received

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

AOS

06-06-2008 Mailed out AOS

06-08-2008 Delivered to Lockbox

06-16-2008 NOA for EAD, AP, AOS(dated June 12)

06-28-2008 Biometrics done!

Yea I saw that.. but the top of the form says EXP 4/31/2007

The 4/31/07 date has to do with survey data collection for Office of Management and Budget, it has to do with the paper-work reduction act, and has nothing to do with the validity of the form.

VII. Paperwork Reduction Act Notice.

You are not required to respond to this form unless it displays a currently valid OMB control number.

We try to create forms and instructions that are accurate, can be easily understood and impose the least possible burden onyou to provide us with information. Often this is difficult because some immigration laws are very complex.

The estimated average time to complete and file this notice is 15 minutes.

It is internal to the government and is how they come up with the 15 minutes quoted on page 2 of it's directions.

Check bottom right of the Form. Mine says "Form I-134 (Rev. 02/28/07)Y..."

Since Edition Date 2/28/07,Versions 12/04/06, 7/14/06 and 6/17/06 are acceptable, it should go.

Timeline

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

I have a question, too: what if the sponsor (petitioner) does NOT make 125% of the poverty line - is it possible to provide assets instead of a co-sponsor or is a co-sponsor always needed in this case ?

In case assets are fine, how much do you have to prove in cash or other assets if you don't want a co-sponsor to file an extra I-134 ?

Assets are fine as long as they are Liquid, that is that the cash is easily obtainable, not something like a house which you would have to sell, and then where would you live.

Asset line money in the bank is good.

assets are worth only 1/3 of income. So if income falls below the line by 1000 you need to have assets valued at 3000.

ok so I have a weird problem. My paystubs show my salary to be 150 a month. It all goes to my exwife. But I get a sizable bonus and a sizable income refund. So my 1040 shows income 5X the poverty level, but my weekly paystubs dont. (only my bonus check does)...

Your pay stub should show salary before deductions, this is the amount they will be looking at. "Gross income", also employer letter should also indicate annual gross salary.
