Look like this has been well covered! I laughed too when I first saw the Embassy juggle with it. She is a non-immigrant but when you marry and go to adjust status she will be now immigrating. So they are saying, treat the K visa like an immigrant visa without the official title.

It's non-immigrant with immigrant intent. If it was "really" an immigrant visa, then no AOS would be necessary.

to make it simple although theres no 3rd type, for us applicants the K visa are under "NON IMMIGRANT WITH IMMIGRANT INTENT" :thumbs: thats better....

Jan 2008 - application was sent back to us due to mis sent to Chicago instead of California

Jan - sent application

Jun 27 - NOA2 by the mailbox!!! (found out that d 2nd touch was d approval..sweet!)

Jul 3 - NVC sent letter to petitioner

Jul 15 - confirmation letter received (tnk u my dear DHL)

Jul 17- 1st day - medical exam SLEC (on hold and waiting for it to be done successfully) July 31- PASSED!

Aug 28 - USEM interview date! (eto' na!) - PASSED - PINK SLIP ONLY!

Sept 26 - PAL departure - MNL-LAX

NOV 23 - Church wedding

AOS

Jan 30 2009 - AOS with EAD and AP submitted to Chi, IL

Feb 4 - check cleared

Feb 10 - AOS, EAD, AP NOA1 received!

Feb 19 - Biometric appointment letter received

Feb 28 - Biometrics schedule

Mar 28 - AP and interview invitation received by mail

Apr 2 - EAD card recieved

May 15 - Interview Schedule - APPROVED!

Jun 25 - GREEN CARD RECEIVED ON MAIL Dated June 16

What makes it even more confusing is that even the consulates are not clear on the concept. For example if you go to the US Embassy in Moscow, then to the Visa Services section, you will find Fiance Visas under the Immigrant Visas section. Go figure.

but what if u already have an immigrant visa petition before that is now pending and sitting in NVC and had K1 visa already approved what do I need to write in DS 156 form #36 HAS ANYONE EVER FILED AN IMMIGRANT VISA PETITION ON YOUR BEHALF? (IF YES,WHO?)

I had an employer before who filed I-140 for me because of retrogression in nurses it was still pending and no visa available. I decided to cancel my immigrant petition once i arrive in vegas coz my fiance doesnt want to relocate in california where my employer is located.

but what if u already have an immigrant visa petition before that is now pending and sitting in NVC and had K1 visa already approved what do I need to write in DS 156 form #36 HAS ANYONE EVER FILED AN IMMIGRANT VISA PETITION ON YOUR BEHALF? (IF YES,WHO?)
