Timeline

we are gathering the paperwork for removal of conditions for me and we need to call for the tax transcripts, now i understand they have to be jointly filed, how many years do we have to send, plus hidden away somewhere i believe i have copies from when we filed AOS can i send those? Am i correct in thinking that removal of conditions is basically sending in a rehash of evidence that we sent for AOS?

4/3/08 package arrives at Nebraska

4/11/08 check cashed

4/14/08 recieved NOA extension letter

4/26/08 recieved biometrics appointment letter plus it looks like our case has been forwarded to California!

5/02/08 Biometrics scheduled

5/02/08 Biometrics completed in 10 mins!

Woo Hoo....8/28/08 Recieved 10yr Greencard in mail, no approved email!! We are done!!!

AOS has no relationship evidence required other than a marriage cert. Affidavit of support requires US Citizen's financial evidence.

You may want to read the I-751 guide, there is a LOT of marital relationship evidence that you need to provide to prove a bona fide relationship.

IRS returns in the case of I-751 has nothing to do with support, they go to show taxes were filed jointly.

I think AOS here was referring to Adjustment of Status, not Affidavit of Support. Acronyms can be confusing and ambiguous.

Anyway, the purpose of the removal of conditions evidence is just to demonstrate the bona fide nature of your marriage. Although the instructions say to submit evidence covering the time from the wedding to the present, most people concentrate on the time period since they were last interviewed by immigration. A lot of people don't submit any evidence from before the time they were first granted conditional LPR status. That usually seems to work, regardless of what the instructions say.

In other words, if you want to give them slight overkill (but still within the letter of what the instructions request), submit tax transcripts that cover every tax return you've filed since you were married. But if you want to lighten the load, only send them the transcripts that they haven't yet seen, i.e. the returns you filed AFTER adjustment of status. Chances are very good they'll have your earlier evidence anyway. People have been successful both ways.

the birth certificate is good evidence of a bona fide marriage...

just send in copies of your evidence, even the birth certificate.. that is all they ask for..

Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in ''good faith'' and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you wish to establish this fact and to demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended.

Send copies of everything -- no originals. Except that the I-751 should have original signatures (preferably in blue ball-point ink, to make it clear that they aren't photocopied signatures).

Your son's birth certificate is already excellent evidence. If you have any evidence that the two of you are sharing parenting duties and raising him as a family unit, that strengthens the case even more. Consider family photos, christmas cards sent, health insurance policy, etc. And don't completely ignore the other categories of evidence not related to the son.

I've been watching here for awhile, and among people who sent a birth certificate plus tax returns and a smattering of other evidence, I haven't seen anyone called for an interview or otherwise reporting any problems. Use due diligence and send copies of the things you have or the things that are easy to obtain, and then send it off and try not to worry about it.

thankyou so much....one last question as we havet dealt with immigration for so long, how do i put all this evidence together, i'm trying to remember how i packaged it all together to send off last time...any sugestions?

In our case we did not send in tax transcripts. I just sent in a copy of the one joint tax return we have filed together so far, along with W-2 statements showing "Married" status. In addition, I made a scan of our tax refund check, made out to us jointly and addressed to our home, and sent that in. I think the joint tax refund check, being a government document, has some weight to it.

So, I mention the jointly filed tax refund check as good evidence. I have not seen this mentioned here before.

how do i put all this evidence together, i'm trying to remember how i packaged it all together to send off last time...any sugestions?

Two hole punched at the top, with an ACCO fastener holding it together, is what they say they prefer. They don't like staples or other things that are hard to disassemble. Tabs on the bottom can identify separate pieces of evidence. See the General Tips page on the USCIS site.

We sent copies of our tax returns, not transcripts. We didn't include our W-2s, but we were still approved without any requests for evidence.

I think tax transcripts are more important during the adjustment of status phase than during removal of conditions.
