:help:

My fiance and I have found ourselves to be in an unfortunate situation and are considering not marrying yet. We've received NOA2 and are simply awaiting receipt at the NVC.

Does anyone know if failure to follow through with the fiance visa at this stage will impact a future application for the same visa or even the K3?

Thanks.

No, failure to complete your visa application will not affect future applications, although they may ask at your next interview why you canceled the first one. Be prepared for that question, but otherwise you should be fine. Best of luck to you.

Well, when you file a second I-129F within two years, you need a letter asking for an IMBRA waiver. The law reads more than two but they seem to be requiring it for number two. You simply explain what happened and ask them to accept the new petition.

For now, though I would just do nothing until later. You can delay the interview for a couple months to say four or five months from now and then she has 6 months to use the visa. Perhaps things will change during one of those time segments.

Facts are cheap...knowing how to use them is precious...

Remember that once you receive your visa....you have up to 6 months to enter the country. That may buy you some time if need be.

Best of luck to you!!! :)

Applicable for Petitions for Alien Fiance(e) only... Petitions for Alien Spouse are not subject to this...

YMMV
