Ok let me explain my situation.

I am an American Citizen and i want to marry a girl who is a Cambodian Citizen. Currently she is in Canada on a Student Visa. My question is what should i do to get married with her to eventually bring her to live in the United States with me. I am so confused on what i need to do.

05/21/07 : I-129F Sent

02/24/08 : INTERVIEW

12/12/07 : MEDICAL

01/09/08 : VISA IN HAND

03/06/08 : Arrive in the US, POE - DETROIT

AOS

03/28/08 : Mailed AOS Packet

04/12/08 : Receive NOA's AP, EAD

05/02/08 : BIOMETRICS

06/11/08 : EAD CARD IN THE MAIL!!!

07/02/08 : GREEN CARD PRODUCTION ORDERED

07/07/08 : GREEN CARD IN THE MAIL & WORKING

03/27/09 : Driver's License issued

Removing Condition

04/03/10 : mailed to Vermont

04/08/10 : NOA1 & 1 yr extension

05/20/10 : Biometrics Appt.

11/19/10 : Interview/Approval

In order to answer this, you need to first ask yourself, do you wish to marry before or after starting a visa petition? You should go to the "Guides" tab here on the top of the VJ page and look over your options. They will give you a rundown of all the different scenerios. Her being in Canada should have zero effect on any of this. Explore the guides as they will serve as a good foundation. Then, return to the forums with specific questions. :)

You would not talk to the Embassy yet. The process begins at the USCIS Service Center that serves your State. The case would eventually get to the Embassy in Cambodia as she is a Cambodian citizen. There are a lot of answers to these questions in the guides and FAQs.

The part i am confused is who should i talk to since she is from Cambodia but is now in Canada on a Student Visa. Would i be talking to the US Embassy in Canada or Cambodia. thanks

The bolded above is true for a fiance visa process and perhaps for a CR1. However, K3 visa Consular processing occurs in the country of marriage. So, should they couple decide to marry in Canada before filing any petition, her visa can be issued in Montreal or Vancouver.

Yes, start with the guides for an overview and then return with remaining questions. You may have many.
