Timeline

me and my girlfriend are planing to file a k1 visa soon , but if every thing worked out in the end and we got married in usa and i got my papers straight and we got divorced , what wil happen to me then ? do i lose my legal stay in usa ? do they ask me to leave ?

Once you have your GC you can stay. That is unless there is proof of fraud.

Surely at this stage of your relationship you should be seeing only the good times ahead & not planning life after divorce?

 

In answer to your question, once you have a green card and can verify the marriage was entered into in good faith then there is no reason you would be deported.

I think it is a good question - why move to another country and not think of the possible consequences.  

 

NOvvA: if possible, get married and file for a spousal visa; it allows you to get a green card as soon as you get to the USA.  This has multiple benefits: you are able to work right away, the total cost to file is lower, and you have a green card if things do not work out later on with your spouse. 

 

With a K1, if you are unable to adjust status for whatever reason, then you might have to leave if things go sour.

I'm sorry what do you mean by that? I guess you can always return to your home country if things didn't do work out and you end up by yourself in another country.

There is nothing wrong with being a realist. Stuff happens, just because a person looks into all their options does not mean there is any fraud. 

 

I looked into everything, there was no fraudulent thoughts. Just making sure before I sold my house moved my kids that once we started a life down here it wasn't going to get ripped away.
