File your new K1 petition you will then find out what the next step is.....whether or not you need a waiver. But the FIRST step is filing a new petition.

"Yes. The new K-1 must be submitted concurrently with the Fraud Waiver. Should you want my firm to help you, I can have the attorney-client fee agreement and the invoice for paying the down payment sent to you. just let me know."

That is the reply of one of the lawyer whom i have consulted. What do you think about his claim ? Is it possible ?

You need a denial in order to file a waiver...think like this what are you waiving they havent denied yet...:blink:

You need a denial in order to file a waiver...think like this what are you waiving they havent denied yet... :blink:

Yes ! i agreed with you. i asked that lawyer to explain to me in details on how the two procedures can be done concurrently. and how he can manage it the same. I have my previous inadmissibility perhaps he contemplates the same denial or grounds that i will be received after my interview. But, the question is clearly am I qualify for a waiver ? that's remain to be seen . Up to now i haven;t received any response from the lawyer.

You can't file the waiver because you haven't been denied for something that qualified. the first petition was denied because you were not free to marry. If you get a new petition and file when you go to your interview you find out if you need a waiver or if you can even file for a waiver. You will not know the answer until you have the interview.

Instead of spending time on a waiver you don't need right now and might not qualify for why not spend time getting the new petition filed?
